CONTENT
The bill would amend the governmental immunity Act to provide that a "nonprofit human service organization" would be immune from tort liability for acts or omissions occurring in the furtherance of the organization's contract with the State to provide services to certain individuals, unless the act or omission constituted gross negligence or violated a Michigan criminal law.
"Nonprofit human service organization" would mean a nonprofit corporation organized under the Nonprofit Corporation Act that was solely dedicated to the care of minors or dependent or indigent mentally, emotionally, or physically impaired persons; was licensed by the Department of Consumer and Industry Services to provide care to those individuals; and provided services to or for those individuals pursuant to a contract with the State.
"Gross negligence" would mean conduct so reckless as to demonstrate a substantial lack of concern for whether an injury resulted.
