        A bill to amend 1969 PA 57, entitled

   "Uniform recognition of acknowledgments act,"

   by amending section 2 (MCL 565.262).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 2.  For the purposes of  AS USED IN this act:  ,

 2     "notarial 

 3         (A) "NOTARIAL acts" means acts  which  THAT the laws of this

 4    state authorize notaries public of this state to perform, includ-

 5    ing the administering of oaths and affirmations, taking proof of

 6    execution and acknowledgments of instruments, and attesting

 7    documents.  Notarial acts may be performed outside this state for

 8    use in this state with the same effect as if performed by a

 9    notary public of this state by the following persons authorized

10    pursuant to the laws and regulations of other governments in

 1    addition to any other person authorized by the laws of this

 2    state:

 3         (i)  (a)  A notary public authorized to perform notarial

 4    acts in the place in which the act is performed.

 5         (ii)  (b)  A judge, clerk, or deputy clerk of any court of

 6    record in the place in which the notarial  act is  ACTS ARE

 7    performed.

 8         (iii)  (c)  An officer of the foreign service of the United

 9    States, a consular agent or any other person authorized by regu-

10    lation of the United States department of state to perform notar-

11    ial acts in the place in which the act is performed.

12         (iv)  (d)  A commissioned officer in active service with the

13    armed forces of the United States and any other person authorized

14    by regulation of the armed forces to perform notarial acts if the

15    notarial  act is  ACTS ARE performed for 1 of the following or

16    his OR HER dependents:  a 

17         (A) A merchant seaman of the United States.  , a 

18         (B) A member of the armed forces of the United States.  or

19     any 

20         (C) ANY other person serving with or accompanying the armed

21    forces of the United States.

22         (v)  (e)  Any other person authorized to perform notarial

23    acts in the place in which the act is performed.

24         (B) "SATISFACTORY EVIDENCE" MEANS EVIDENCE UPON WHICH RELI-

25    ANCE IS PLACED UPON EITHER OF THE FOLLOWING:

26         (i) THE SWORN WORD OF A CREDIBLE WITNESS WHO IS PERSONALLY

27    KNOWN TO THE NOTARY PUBLIC AND WHO PERSONALLY KNOWS THE SIGNER.

 1         (ii) A CURRENT IDENTIFICATION CARD OR DOCUMENT ISSUED BY A

 2    FEDERAL OR STATE GOVERNMENT THAT CONTAINS THE BEARER'S PHOTOGRAPH

 3    AND SIGNATURE.
