        A bill to amend 1984 PA 431, entitled

   "The management and budget act,"

   by amending section 267 (MCL 18.1267).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 267.  (1) The department shall issue directives to pro-

 2    vide for the disclosure, transfer, and disposal of surplus, sal-

 3    vage, and scrap material of state agencies.  The department may

 4    dispose of surplus,  and of  salvage, or scrap by  donating  ANY

 5    OF THE FOLLOWING MEANS:

 6         (A) DONATING or selling the  property or equipment  MATERIAL

 7    to a unit of local government.  or by selling 

 8         (B) SELLING the  surplus, salvage, or scrap  MATERIAL at

 9    auction.

10         (C) DONATING OR SELLING THE MATERIAL TO A SHELTER FOR

11    HOMELESS PERSONS, FOOD KITCHEN, FOOD BANK, OR OTHER ENTITY WHOSE

 1    PRIMARY PURPOSE IS TO PROVIDE OVERNIGHT ACCOMMODATION, FOOD, OR

 2    MEALS FOR INDIGENT INDIVIDUALS, IF A CONTRIBUTION TO THAT ENTITY

 3    IS TAX DEDUCTIBLE FOR THE DONOR UNDER THE INTERNAL REVENUE CODE.

 4         (2) The department may pay necessary costs incurred in the

 5    conduct of the transfers or auctions of the  property or

 6     equipment  MATERIAL, including the necessary warehousing and

 7    reconditioning costs, from the proceeds of the auction or by

 8    assessing a handling fee for  property or equipment  THE MATERIAL

 9    being donated.
