HOUSE BILL No. 5147


     September 30, 1997, Introduced by Reps. Brackenridge, Birkholz, Crissman, Hammerstrom and Dobronski and referred to the Committee on Local Government.


        A bill to amend 1943 PA 183, entitled

   "County zoning act,"

   (MCL 125.201 to 125.240) by amending the title, as amended by

   1996 PA 569, and by adding section 12a.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1                                  TITLE

 2         An act to provide for the establishment in portions of coun-

 3    ties lying outside the limits of incorporated cities and villages

 4    of zoning districts within which the proper use of land and natu-

 5    ral resources may be encouraged or regulated by ordinance, and

 6    for which districts provisions may also be adopted designating

 7    the location of, the size of, the uses that may be made of, the

 8    minimum open spaces, sanitary, safety, and protective measures

 9    that are required for, and the maximum number of families that

10    may be housed in dwellings, buildings, and structures that are

 1    erected or altered; to designate the use of certain state

 2    licensed residential facilities; to provide for a method for the

 3    adoption of ordinances and amendments to ordinances; to provide

 4    for emergency interim ordinances; to provide by ordinance for the

 5    acquisition by purchase, condemnation, or otherwise, of property

 6    that does not conform to the requirements of the zoning districts

 7    so provided; to provide for the administering of ordinances

 8    adopted; to provide for conflicts with other acts, ordinances, or

 9    regulations; to provide sanctions for violations; to provide for

10    the assessment, levy, and collection of taxes; to provide for

11    referenda; to provide for appeals; to authorize the purchase of

12    development rights; to authorize the issuance of bonds and notes;

13     and  to provide for special assessments; AND TO PRESCRIBE PENAL-

14    TIES AND PROVIDE REMEDIES.

15         SEC. 12A.  A PETITION UNDER SECTION 12, INCLUDING THE CIRCU-

16    LATION AND SIGNING OF THE PETITION, IS SUBJECT TO SECTION 488 OF

17    THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 168.488.  A PERSON

18    WHO VIOLATES A PROVISION OF THE MICHIGAN ELECTION LAW, 1954 PA

19    116, MCL 168.1 TO 168.992, APPLICABLE TO A PETITION DESCRIBED IN

20    THIS SECTION IS SUBJECT TO THE PENALTIES PRESCRIBED FOR THAT VIO-

21    LATION IN THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 168.1 TO

22    168.992.

23         Enacting section 1.  This amendatory act does not take

24    effect unless Senate Bill No. _____ or House Bill No. _____

25    (request no. 02378'97) of the 89th Legislature is enacted into

26    law.
