HOUSE BILL No. 5148


     September 30, 1997, Introduced by Reps. Brackenridge, Birkholz, Crissman, Hammerstrom and Dobronski and referred to the Committee on Local Government.


        A bill to amend 1943 PA 184, entitled

   "Township zoning act,"

   (MCL 125.271 to 125.310) by amending the title, as amended by

   1996 PA 570, and by adding section 12a.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1                                  TITLE

 2         An act to provide for the establishment in townships of

 3    zoning districts within which the proper use of land and natural

 4    resources may be encouraged or regulated by ordinance, and for

 5    which districts provisions may also be adopted designating the

 6    location of, the size of, the uses that may be made of, the mini-

 7    mum open spaces, sanitary, safety, and protective measures that

 8    shall be required for, and the maximum number of families that

 9    may be housed in dwellings, buildings, and structures, including

10    tents and trailer coaches, that are erected or altered; to

 1    designate the use of certain state licensed residential

 2    facilities; to provide for a method for the adoption of ordi-

 3    nances and amendments to ordinances; to provide for emergency

 4    interim ordinances; to provide for the acquisition by purchase,

 5    condemnation, or otherwise of nonconforming property; to provide

 6    for the administering of ordinances adopted; to provide for con-

 7    flicts with other acts, ordinances, or regulations; to provide

 8    sanctions for violations; to provide for the assessment, levy,

 9    and collection of taxes; to provide for the collection of fees

10    for building permits; to provide for petitions, public hearings,

11    and referenda; to provide for appeals; to authorize the purchase

12    of development rights; to authorize the issuance of bonds and

13    notes;  and  to provide for special assessments; AND TO PRESCRIBE

14    PENALTIES AND PROVIDE REMEDIES.

15         SEC. 12A.  A PETITION UNDER SECTION 12, INCLUDING THE CIRCU-

16    LATION AND SIGNING OF THE PETITION, IS SUBJECT TO SECTION 488 OF

17    THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 168.488.  A PERSON

18    WHO VIOLATES A PROVISION OF THE MICHIGAN ELECTION LAW, 1954 PA

19    116, MCL 168.1 TO 168.992, APPLICABLE TO A PETITION DESCRIBED IN

20    THIS SECTION IS SUBJECT TO THE PENALTIES PRESCRIBED FOR THAT VIO-

21    LATION IN THE MICHIGAN ELECTION LAW, 1954 PA 116, MCL 168.1 TO

22    168.992.

23         Enacting section 1.  This amendatory act does not take

24    effect unless Senate Bill No. _____ or House Bill No. _____

25    (request no. 02378'97) of the 89th Legislature is enacted into

26    law.
