HOUSE BILL No. 5359 November 6, 1997, Introduced by Reps. A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending sections 43524, 43526, 43527, 43535, 43537, and 43546 (MCL 324.43524, 324.43526, 324.43527, 324.43535, 324.43537, and 324.43546), as amended by 1996 PA 585; and to repeal acts and parts of acts. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 43524. (1) A person shall not hunt wild turkey without 2 a wild turkey hunting license. THE FEE FOR A RESIDENT WILD 3 TURKEY HUNTING LICENSE FOR A SENIOR CITIZEN IS $1.00. The fee for 4 a resident wild turkey hunting license is $13.00. Beginning in 5 1999, the fee for a resident wild turkey hunting license is 6 $14.00. Beginning in 2001, the fee for a resident wild turkey 7 hunting license is $15.00. The fee for a nonresident wild turkey 8 hunting license is $60.00. Beginning in 1999, the fee for a 04160'97 TMV 2 1 nonresident wild turkey hunting license is $65.00. Beginning in 2 2001, the fee for a nonresident wild turkey hunting license is 3 $69.00. Applications for a wild turkey hunting license shall be 4 entered into a lottery designed and run by the department. A 5 person selected in the lottery, upon meeting the requirements of 6 this part, is authorized to purchase a wild turkey hunting 7 license. The license shall be issued for a specified hunting 8 period and shall confer upon the holder of the license the right 9 to hunt wild turkeys. 10 (2) From the fee collected for each wild turkey hunting 11 license and application for a license, the following amounts 12 shall be used for scientific research, biological survey work on 13 wild turkeys, and wild turkey management in this state: 14 (a) Resident wild turkey hunting license....$ 9.50 15 (b) Nonresident wild turkey hunting license.$50.00 16 (c) Senior wild turkey hunting license......$ 1.00 17 (d) Wild turkey hunting application.........$ 3.00. 18 (3) The department shall charge a nonrefundable application 19 fee not to exceed $4.00 for each person who applies for a wild 20 turkey hunting license. 21 Sec. 43526. (1)ASUBJECT TO SECTION 43535, A person 22 shall not hunt deer during the firearm deer season without pur- 23 chasing a firearm deer license. The fee for a resident firearm 24 deer license is $13.00. Beginning in 1999, the fee for a resi- 25 dent firearm deer license is $14.00. Beginning in 2001, the fee 26 for a resident firearm deer license is $15.00. The fee for a 27 nonresident firearm deer license is $120.00. Beginning in 1999, 04160'97 3 1 the fee for a nonresident firearm deer license is $129.00. 2 Beginning in 2001, the fee for a nonresident firearm deer license 3 is $138.00. Where authorized by the department, a resident or 4 nonresident may purchase a second firearm deer license in 1 5 season for the fee assessed under this subsection for the firearm 6 deer license for which that person is eligible.However, a7senior license discount is not available for the purchase of a8second firearm deer license.WHERE AUTHORIZED BY THE DEPARTMENT, 9 A SENIOR CITIZEN MAY PURCHASE A FIREARM DEER LICENSE FOR A SECOND 10 DEER IN 1 SEASON FOR THE FEE ASSESSED UNDER THIS SUBSECTION FOR A 11 RESIDENT FIREARM DEER LICENSE. The department may issue orders 12 under part 401 designating the kind of deer that may be taken and 13 the geographic area in which any license issued under this sec- 14 tion is valid, when advisable in managing deer. 15 (2) The department may issue a kill tag with or as part of 16 each deer license. The kill tag shall bear the license number. 17 The kill tag may also include space for other pertinent informa- 18 tion required by the department. The kill tag, if issued, is 19 part of the license. 20 (3) The department shall charge a nonrefundable application 21 fee not to exceed $4.00 for each person who applies for an ant- 22 lerless deer license. Except as otherwise provided in 23 section 43521, the fee for a resident antlerless deer license is 24 $13.00. Beginning in 1999, the fee for a resident antlerless 25 deer license is $14.00. Beginning in 2001, the fee for a resi- 26 dent antlerless deer license is $15.00. The fee for a 27 nonresident antlerless deer license is $120.00. Beginning in 04160'97 4 1 1999, the fee for a nonresident antlerless deer license is 2 $129.00. Beginning in 2001, the fee for a nonresident antlerless 3 deer license is $138.00. 4 Sec. 43527. (1) A person shall not hunt deer with a bow and 5 arrow or crossbow during the bow and arrow deer season without a 6 bow and arrow deer license. The fee for a resident bow and arrow 7 deer license is $13.00. Beginning in 1999, the fee for a resi- 8 dent bow and arrow deer license is $14.00. Beginning in 2001, 9 the fee for a resident bow and arrow deer license is $15.00. The 10 fee for a resident or nonresident who is 12 years of age through 11 16 years of age for a bow and arrow deer license shall be dis- 12 counted 50% from the cost of the resident bow and arrow deer 13 license. The fee for a nonresident bow and arrow deer license is 14 $120.00. Beginning in 1999, the fee for a nonresident bow and 15 arrow deer license is $129.00. Beginning in 2001, the fee for a 16 nonresident bow and arrow deer license is $138.00. Where autho- 17 rized by the department, a person may purchase a second bow and 18 arrow deer license in 1 season for the fee assessed under this 19 subsection for the bow and arrow deer license for which that 20 person is eligible.However, a senior license discount is not21available for the purchase of a second bow and arrow deer22license.WHERE AUTHORIZED BY THE DEPARTMENT, A SENIOR CITIZEN 23 MAY PURCHASE A BOW AND ARROW DEER LICENSE FOR A SECOND DEER IN 1 24 SEASON FOR THE FEE ASSESSED UNDER THIS SUBSECTION FOR A RESIDENT 25 BOW AND ARROW DEER LICENSE. The department may issue orders under 26 part 401 designating the kind of deer which may be taken and the 04160'97 5 1 geographic area in which any license issued under this section is 2 valid, when advisable in managing deer. 3 (2) The department may issue a kill tag with, or as a part 4 of, each bow and arrow deer license. Section 43526(2) applies 5 with respect to a bow and arrow deer license. 6 Sec. 43535. Aresident of this state who is 65 years of7age or olderSENIOR CITIZEN may obtain a COMBINED senior HUNTING 8 AND FISHING LICENSE. THE COMBINED SENIOR HUNTING AND FISHING 9 LICENSE SHALL SERVE AS A COMBINATION small game license,a10seniorfirearm deer license,a seniorbow and arrow deer 11 license,a seniorbear hunting license,a senior wild turkey12hunting license, or a seniorfur harvester's license, AND 13 ALL-SPECIES FISHING LICENSE. The fee for each COMBINED senior 14 license shall bediscounted 60% from the fee for the resident15license.AS FOLLOWS: 16 (A) BEFORE 2000, NO FEE. 17 (B) BEGINNING IN 2000, $5.00. 18 (C) BEGINNING IN 2005, $10.00. 19 (D) BEGINNING IN 2010, $15.00. 20 Sec. 43537. (1) A resident who is declared legally blind is 21 eligible to purchase a seniorrestricted or senior all-species22 HUNTING AND fishing license. The department may demand proof of 23 blindness. The licensee, when fishing, shall possess proof of 24 blindness and shall furnish the proof upon the request of a peace 25 officer. 26 (2) A resident who has been determined by the United States 27 department of veterans affairs to be permanently and totally 04160'97 6 1 disabled and entitled to veteran benefits at the 100% rate, for a 2 disability other than blindness, is eligible to purchaseany3senior hunting license as described in section 43535 or any4senior fishing license described in section 43536, or bothA 5 SENIOR HUNTING AND FISHING LICENSE. The department may demand 6 proof of eligibility under this subsection. The licensee, when 7 hunting or taking aquatic species, shall possess proof of his or 8 her eligibility under this subsection and shall furnish the proof 9 upon the request of a peace officer. 10 (3) The department shall process licenses issued under this 11 section in the same manner as licenses issued to senior citizens 12 for purposes of receiving appropriations from the legislature 13 under section 43546. 14 Sec. 43546. (1) Before June 1 of each year, the department 15 shall determine the total number of senior hunting and fishing 16 licenses issued and the total fees collected the preceding 17 license year. The department shall determine the total fees that 18 would have been collected if those senior citizens had been 19 required to purchasefull-price resident hunting andRESIDENT 20 SMALL GAME LICENSES, FIREARM DEER LICENSES, AND RESTRICTED fish- 21 ing licenses during the preceding license year. From this total, 22 the department shall subtract the fees collected from the sale of 23 senior hunting and fishing licenses during the preceding license 24 year. The difference is the amount that would otherwise be 25 collected. 26 (2) The legislature shall annually appropriate from the 27 general fund a sum equal to the fees that would otherwise be 04160'97 7 1 collected as determined pursuant to subsection (1). The sum 2 appropriated shall be credited to the game and fish protection 3 fund. 4 Enacting section 1.
