HOUSE BILL No. 5767 April 23, 1998, Introduced by Reps. Stallworth, Kilpatrick, Hale and Thomas and referred to the Committee on Appropriations. A bill to establish a commission of inner-city development; and to prescribe the commission's powers and duties. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. This act shall be known and may be cited as the 2 "commission of inner-city development act". 3 Sec. 2. As used in this act: 4 (a) "Chairperson" means the chairperson of the commission. 5 (b) "Commission" means the commission of inner-city develop- 6 ment created in section 3. 7 (c) "Major employer" means an employer of more than 50 8 full-time employees. 9 (d) "Urban area" means an urbanized area as determined by 10 the economic and statistics administration, United States bureau 11 of the census according to the 1990 census. 05768'98 DMS 2 1 Sec. 3. (1) The commission of inner-city development is 2 created in the Michigan jobs commission and consists of 7 members 3 as follows: 4 (a) One member representing consumers appointed by the 5 senate majority leader. 6 (b) One member representing consumers appointed by the 7 speaker of the house of representatives. 8 (c) Two members representing minority-owned businesses, 9 appointed by the governor with the advice and consent of the 10 senate. 11 (d) Two members representing individuals with business 12 development expertise, appointed by the governor with the advice 13 and consent of the senate. 14 (e) The director of the department of consumer and industry 15 services, who shall serve as an ex officio, nonvoting member. 16 (2) Commission members appointed by the governor shall be 17 appointed for terms of 2 years, except that of the members first 18 appointed, 1 member shall serve for 1 year and 1 member shall 19 serve for 2 years. Commission members appointed by the senate 20 majority leader or the speaker of the house of representatives 21 shall be appointed for terms of 2 years. A vacancy created other 22 than by the expiration of a term shall be filled for the balance 23 of the unexpired term in the same manner as the original 24 appointment. A member may be reappointed for additional terms. 25 (3) The commission shall elect annually from its membership 26 a chairperson, vice-chairperson, and other officers that the 27 commission considers necessary. The chairperson is the chief 05768'98 3 1 executive officer of the commission. an executive director in 2 accordance with civil service procedures who shall serve as sec- 3 retary to the commission. 4 (4) A commission member shall receive reimbursement only for 5 actual and necessary expenses incurred in the performance of the 6 commission's business. 7 Sec. 4. (1) The commission shall comply with the open meet- 8 ings act, 1976 PA 267, MCL 15.261 to 15.275, in conducting busi- 9 ness and in providing public notice of the time, date, and place 10 of commission meetings. 11 (2) In accordance with the freedom of information act, 1976 12 PA 442, MCL 15.231 to 15.246, the commission shall make available 13 to the public a writing prepared, owned, used, in the possession 14 of, or retained by the commission in the performance of an offi- 15 cial function. 16 Sec. 5. The commission shall do both of the following: 17 (a) Create and make available to the public a directory of 18 state services and tax advantages available to assist major 19 employers in locating their businesses in urban areas of this 20 state. 21 (b) Provide to major employers technical assistance relating 22 to Michigan statutes that may affect business activities in this 23 state. 24 Sec. 6. The executive director of the commission shall 25 implement the policies and programs of the commission and be 26 responsible for staff assignments and the administration of the 05768'98 4 1 commission office. The executive director shall also perform 2 additional duties as assigned by the chairperson. 3 Sec. 7. The commission may accept federal funds or private 4 gifts or donations. However, the acceptance and use of federal 5 funds does not commit state funds and does not place any obliga- 6 tion upon the legislature to continue the purpose for which the 7 funds are made available. 8 Sec. 8. All executive departments and agencies of this 9 state shall fully cooperate with the commission in the per- 10 formance of the commission's duties. 05768'98 Final page. DMS
