A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending sections 43524, 43526, 43527, 43528, 43530, 43531, and 43532 (MCL 324.43524, 324.43526, 324.43527, 324.43528, 324.43530, 324.43531, and 324.43532), as amended by 1996 PA 585; and to repeal acts and parts of acts. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 43524. (1) A person shall not hunt wild turkey without 2 a wild turkey hunting license. The fee for a resident wild 3 turkey hunting license is $13.00. Beginning in 1999, the fee 4 for a resident wild turkey hunting license is $14.00. Beginning 5 in 2001, the fee for a resident wild turkey hunting license is 6 $15.00. The fee for a nonresident wild turkey hunting license is 7 $60.00. Beginning in 1999, the fee for a nonresident wild 8 turkey hunting license is $65.00. Beginning in 2001, the fee for 05098'97 TMV 2 1 a nonresident wild turkey hunting license is $69.00. 2 Applications for a wild turkey hunting license shall be entered 3 into a lottery designed and run by the department. A person 4 selected in the lottery, upon meeting the requirements of this 5 part, is authorized to purchase a wild turkey hunting license. 6 The license shall be issued for a specified hunting period and 7 shall confer upon the holder of the license the right to hunt 8 wild turkeys. 9 (2) From the fee collected for each wild turkey hunting 10 license and application for a license, the following amounts 11 shall be used for scientific research, biological survey work on 12 wild turkeys, and wild turkey management in this state: 13 (a) Resident wild turkey hunting license....$ 9.50 14 (b) Nonresident wild turkey hunting license.$50.00 15 (c) Senior wild turkey hunting license......$ 1.00 16 (d) Wild turkey hunting application.........$ 3.00. 17 (3) The department shall charge a nonrefundable application 18 fee not to exceed $4.00 for each person who applies for a wild 19 turkey hunting license. 20 Sec. 43526. (1) A person shall not hunt deer during the 21 firearm deer season without purchasing a firearm deer license. 22 The fee for a resident firearm deer license is $13.00. 23 Beginning in 1999, the fee for a resident firearm deer license 24 is $14.00. Beginning in 2001, the fee for a resident firearm 25 deer license is $15.00. The fee for a nonresident firearm deer 26 license is $120.00. Beginning in 1999, the fee for a 27 nonresident firearm deer license is $129.00. Beginning in 2001, 05098'97 3 1 the fee for a nonresident firearm deer license is $138.00. Where 2 authorized by the department, a resident or nonresident may pur- 3 chase a second firearm deer license in 1 season for the fee 4 assessed under this subsection for the firearm deer license for 5 which that person is eligible. However, a senior license dis- 6 count is not available for the purchase of a second firearm deer 7 license. The department may issue orders under part 401 desig- 8 nating the kind of deer that may be taken and the geographic area 9 in which any license issued under this section is valid, when 10 advisable in managing deer. 11 (2) The department may issue a kill tag with or as part of 12 each deer license. The kill tag shall bear the license number. 13 The kill tag may also include space for other pertinent informa- 14 tion required by the department. The kill tag, if issued, is 15 part of the license. 16 (3) The department shall charge a nonrefundable application 17 fee not to exceed $4.00 for each person who applies for an ant- 18 lerless deer license. Except as otherwise provided in 19 section 43521, the fee for a resident antlerless deer license is 20 $13.00. Beginning in 1999, the fee for a resident antlerless 21 deer license is $14.00. Beginning in 2001, the fee for a resi- 22 dent antlerless deer license is $15.00. The fee for a nonresi- 23 dent antlerless deer license is $120.00. Beginning in 1999, the 24 fee for a nonresident antlerless deer license is $129.00. 25 Beginning in 2001, the fee for a nonresident antlerless deer 26 license is $138.00. 05098'97 4 1 Sec. 43527. (1) A person shall not hunt deer with a bow and 2 arrow or crossbow during the bow and arrow deer season without a 3 bow and arrow deer license. The fee for a resident bow and arrow 4 deer license is $13.00. Beginning in 1999, the fee for a resi- 5 dent bow and arrow deer license is $14.00. Beginning in 2001, 6 the fee for a resident bow and arrow deer license is $15.00. The 7 fee for a resident or nonresident who is 12 years of age through 8 16 years of age for a bow and arrow deer license shall be dis- 9 counted 50% from the cost of the resident bow and arrow deer 10 license. The fee for a nonresident bow and arrow deer license is 11 $120.00. Beginning in 1999, the fee for a nonresident bow and 12 arrow deer license is $129.00. Beginning in 2001, the fee for a 13 nonresident bow and arrow deer license is $138.00. Where autho- 14 rized by the department, a person may purchase a second bow and 15 arrow deer license in 1 season for the fee assessed under this 16 subsection for the bow and arrow deer license for which that 17 person is eligible. However, a senior license discount is not 18 available for the purchase of a second bow and arrow deer 19 license. The department may issue orders under part 401 desig- 20 nating the kind of deer which may be taken and the geographic 21 area in which any license issued under this section is valid, 22 when advisable in managing deer. 23 (2) The department may issue a kill tag with, or as a part 24 of, each bow and arrow deer license. Section 43526(2) applies 25 with respect to a bow and arrow deer license. 26 Sec. 43528. (1) A person shall not hunt bear without a bear 27 hunting license. The fee for a resident bear hunting license is 05098'97 5 1 $13.00. Beginning in 1999, the fee for a resident bear hunting 2 license is $14.00. Beginning in 2001, the fee for a resident 3 bear hunting license is $15.00. The fee for a nonresident bear 4 hunting license is $150.00. 5 (2) The department may issue a tag with, or as a part of, a 6 bear hunting license. Section 43526(2) applies with respect to a 7 bear hunting license. 8 (3) In addition to the license fees in subsection (1), the 9 department shall charge a nonrefundable application fee not to 10 exceed $4.00 for each person who applies for a bear hunting 11 license. 12 Sec. 43530. (1) A person shall not hunt small game on 13 shooting preserves licensed under part 417 without a small game 14 license as provided in section 43523. However, instead of a 15 small game license, a person may obtain a special shooting pre- 16 serve license for a fee of $13.00. Beginning in 1999, the fee 17 for a shooting preserve license is $14.00. Beginning in 2001, 18 the fee for a shooting preserve license is $15.00. 19 (2) Each shooting preserve license shall have the date of 20 issue affixed to the license and shall authorize the holder to 21 hunt only on licensed shooting preserves and only for species for 22 which the shooting preserve is licensed. 23 Sec. 43531. (1) Except as otherwise provided in section 24 43523(1), a person shall not trap or hunt fur-bearing animals 25 without purchasing and possessing a fur harvester's license. The 26 fee for a resident fur harvester's license is $13.00. Beginning 27 in 1999, the fee for a resident fur harvester's license is 05098'97 6 1 $14.00. Beginning in 2001, the fee for a resident fur 2 harvester's license is $15.00. The fee for a resident or nonres- 3 ident who is 12 years of age through 16 years of age for a fur 4 harvester's license shall be discounted 50% from the cost of the 5 resident fur harvester's license. 6 (2) The department may issue a nonresident fur harvester's 7 license to a nonresident of this state if the state, province, or 8 country in which the nonresident applicant resides allows resi- 9 dents of this state to obtain equivalent hunting and trapping 10 privileges in that state, province, or country. The fee for an 11 eligible nonresident fur harvester's license is $150.00. 12 Nonresident fur harvester's licenses shall not be sold or pur- 13 chased prior to BEFORE November 15 of each year. 14 (3) A person who holds a fur harvester's license may hunt 15 fur-bearing animals during the season open to taking fur-bearing 16 animals with firearms and may trap fur-bearing animals during the 17 season open to trapping fur-bearing animals. 18 Sec. 43532. (1) A person 17 years of age or older shall not 19 take aquatic species, except aquatic insects, in the waters over 20 which this state has jurisdiction without a license. The fee for 21 a resident restricted fishing license is $13.00. Beginning in 22 1999, the fee for a resident restricted fishing license is 23 $14.00. Beginning in 2001, the fee for a resident restricted 24 fishing license is $15.00. The fee for a nonresident restricted 25 fishing license is $26.00. Beginning in 1999, the fee for a 26 nonresident restricted fishing license is $30.00. Beginning in 05098'97 7 1 2001, the fee for a nonresident restricted fishing license is 2 $34.00. 3 (2) The restricted fishing license entitles the licensee to 4 take aquatic species as prescribed by law other than trout or 5 salmon. 6 (3) A person 12 years of age or older but less than 17 years 7 of age may take aquatic species in the waters over which this 8 state has jurisdiction without a license. However, a person 12 9 years of age or older but less than 17 years of age may obtain an 10 all-species fishing license. The fee for a resident or nonresi- 11 dent who is 12 years of age or older but less than 17 years of 12 age for an all-species fishing license is $2.00. The department 13 shall provide a Michigan fishing patch to the licensee with the 14 license. The department shall not sell or vendor the list of 15 licensees under this subsection. 16 (4) A resident may purchase an all-species fishing license 17 upon payment of a fee of $26.00. Beginning in 1999, the fee for 18 a resident all-species fishing license is $27.00. Beginning in 19 2001, the fee for a resident all-species fishing license is 20 $28.00. The fee for a nonresident all-species fishing license is 21 $39.00. Beginning in 1999, the fee for a nonresident 22 all-species fishing license is $41.00. Beginning in 2001, the 23 fee for a nonresident all-species fishing license is $42.00. 24 (5) The all-species fishing license entitles the licensee to 25 take all species of aquatic species as prescribed by law. 26 (6) Any holder of a valid restricted fishing license may 27 return the restricted license to the department or its authorized 05098'97 8 1 agent and receive an all-species fishing license by paying a fee 2 equal to the difference in cost between the all-species fishing 3 license and the restricted fishing license for which that person 4 is eligible. 5 Enacting section 1.
