A SUMMARY OF HOUSE BILL 4224 AS INTRODUCED 2-9-99


Under the Public Health Code, the Department of Consumer and Industry Services is required to make a number of inspections and visits to licensed health facilities, including nursing homes. Specifically, the code requires at least one unannounced visit to each nursing home, in addition to visits made to investigate complaints (which are required to be unannounced). Further, the department is required to make at least a biennial visit to each nursing home for the purposes of survey, evaluation, and consultation.


House Bill 4224 would replace these requirements with a requirement that the department, at least annually, make an unannounced visit and inspect each nursing home licensed under the Public Health Code, regardless of whether the home was certified under Title XVIII [Medicare] or Title XIX [Medicaid] of the federal Social Security Act. (The bill would leave unchanged the code's requirement for unannounced visits to investigate complaints.)
