A SUMMARY OF HOUSE BILLS 5432 AND 5433 AS INTRODUCED 2-22-00


House Bill 5432 would amend the Michigan Penal Code (MCL 750.167 and 750.168) to increase the penalties for window peeping and to provide harsher penalties for those who "peep" at a minor. The bill would also specify that a window peeping violation would not depend on whether the peeper was, at the time of the violation, trespassing or on public or private property. Under current law, window peeping is a misdemeanor under the prohibitions against disorderly conduct. Under the bill, a window peeping violation, where the victim is 18 years old or older, would be a misdemeanor; window peeping at a victim who was under the age of 18 would be a felony. The misdemeanor would be punishable by no more than one year imprisonment and/or a fine of up to $500. Felony window peeping would be punishable by no more than four years imprisonment and/or a fine of up to $2,000.


In addition, a the bill would eliminate a provision that prevents a person who has been convicted of neglecting to support his or her family from being charged as a second, third, and subsequent offender, unless his or her family is receiving public support or relief.

House Bill 5433 would amend the Code of Criminal Procedure (MCL 777.16i) to include the crime of felony window peeping as a class F crime against public order with a 4 year statutory maximum.
