A SUMMARY OF HOUSE BILL 5641 AS INTRODUCED 4-18-00


Currently, the Natural Resources and Environmental Protection Act (NREPA) prohibits the owners or operators of landfills or municipal solid waste incinerators from accepting solid waste if they know or should know that the solid waste to be disposed of includes yard clippings generated or collected on land owned by a county, municipality, or a state facility. And as of March 28, 1995, owners and operators of landfills or municipal solid waste incinerators cannot accept solid waste that they know or should know includes yard clippings from any source. There is an exception for yard clippings that are diseased or infested.


The bill would amend this section of the act to allow landfills to accept yard clippings disposed of from November 15 to April 1 of any year.
