A SUMMARY OF HOUSE BILL 5670 AS INTRODUCED 4-20-00
The Natural Resources and Environmental Protection Act allows the Department of Natural Resources to adopt fishing orders it considers necessary for the harvest of new species of game fish, including coho or silver salmon, kokanee salmon, chinook salmon, and striped bass in any of the waters of the state. The bill would amend this provision to specify that, notwithstanding any other provision of the act, the department could adopt fishing orders it considers necessary for the harvest of salmon and trout, including coho salmon, chinook salmon, pink salmon, atlantic salmon, lake trout, brook trout, brown trout, rainbow trout, and splake, on the Great Lakes and their connecting waters. The bill would further provide that the adoption of an order under this provision would be subject to the notice and other procedural requirement of Section 41103 of the act. [Section 41103 provides that if the department determines that any fish, game or fur-bearing animals, or game birds are in danger of depletion or extermination and require additional protection in any area of the state, the department may issue an order suspending or abridging the open season on the taking or killing of a particular species in a particular area. The provision goes on to specify procedural requirements for such orders, requiring them to be specific and to be published in a certain manner so as to notify the public.]
