     February 2, 1999, Introduced by Reps. Kukuk, Garcia, Sheltrown, Gilbert, Jelinek, Mortimer, Kowall, DeHart, Julian, Green, Voorhees and Rocca and referred to the Committee on Conservation and Outdoor Recreation.


        A bill to amend 1927 PA 372, entitled

   "An act to regulate and license the selling, purchasing, possess-
   ing, and carrying of certain firearms and gas ejecting devices;
   to prohibit the buying, selling, or carrying of certain firearms
   and gas ejecting devices without a license; to provide for the
   forfeiture of firearms possessed in violation of this act; to
   provide immunity from civil liability under certain circum-
   stances; to prescribe the powers and duties of certain state and
   local agencies; and to repeal all acts and parts of acts incon-
   sistent with the provisions of this act,"

   by amending section 12 (MCL 28.432) and by adding section 5.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         SEC. 5.  THIS ACT DOES NOT APPLY TO ANY OF THE FOLLOWING:

 2         (A) THE MANUFACTURE, SALE, DISTRIBUTION, OR POSSESSION OF

 3    BLACK GUNPOWDER FOR ANTIQUE FIREARMS.

 4         (B) THE USE OF BLACK GUNPOWDER IN AN ANTIQUE FIREARM.

 5         (C) THE MANUFACTURE, SALE, DISTRIBUTION, OR POSSESSION OF A

 6    SUBSTITUTE FOR BLACK GUNPOWDER FOR ANTIQUE FIREARMS.

 1         (D) THE USE OF A SUBSTITUTE FOR BLACK GUNPOWDER IN AN

 2    ANTIQUE FIREARM.

 3         Sec. 12.  Sections 2 and 9 do not apply to  a  ANY OF THE

 4    FOLLOWING:

 5         (A) A duly authorized police or correctional agency of the

 6    United States,  or of the  THIS state, or  any  A POLITICAL sub-

 7    division  thereof, nor to the  OF THIS STATE.

 8         (B) THE UNITED STATES army, air force, navy, or marine

 9    corps.  of the United States, nor to organizations 

10         (C) AN ORGANIZATION authorized by law to purchase or receive

11    weapons from the United States or from this state.  , nor to the 

12         (D) THE national guard, armed forces reserves, or other duly

13    authorized military organizations.  , or to members of the above

14     agencies or organizations 

15         (E) A MEMBER OF AN ENTITY DESCRIBED IN SUBDIVISIONS (A) TO

16    (D) for  weapons  A WEAPON used for the purposes of or incidental

17    to  such agencies  THE FUNCTIONS OF THAT AGENCY or

18     organizations, nor to a  ORGANIZATION.

19         (F) A person holding a license to carry a pistol concealed

20    upon his OR HER person issued by another state.  , nor to the 

21         (G) THE regular and ordinary transportation of pistols as

22    merchandise by authorized agents of any person licensed to manu-

23    facture firearms.

24         (H) AN ANTIQUE FIREARM.
