        A bill to amend 1970 PA 202, entitled

   "Explosives act of 1970,"

   by amending section 3 (MCL 29.43).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 3.  (1)  A  EXCEPT AS OTHERWISE PROVIDED IN THIS SEC-

 2    TION, A person shall not handle, store, control, use, sell, pur-

 3    chase, transfer, transport, or otherwise dispose of an explosive

 4    unless he OR SHE has applied for, obtained, and has on his OR HER

 5    person a valid permit as prescribed by this act.  , except that: 

 6         (2)  (a)  This section does not apply to an employee, or

 7    agent other than an independent contractor, acting in the scope

 8    and course of his OR HER employment or agency and under the

 9    supervision of his OR HER employer or principal, where the

10    employer or principal has applied for and obtained a valid

11    permit.

 1         (3)  (b)  A person  need not have the permit on his person

 2     where he  WHO is only storing explosives IS NOT REQUIRED TO HAVE

 3    A PERMIT ON HIS OR HER PERSON.

 4         (4) A PERMIT IS NOT REQUIRED FOR A PERSON TO SELL OR PUR-

 5    CHASE BLACK POWDER OR A SUBSTITUTE FOR BLACK POWDER THAT IS MANU-

 6    FACTURED FOR AND INTENDED FOR USE IN ANTIQUE FIREARMS.
