A bill to amend 1931 LA 1, entitled "An act to prevent hunting on Sunday, in the county of Lenawee; to authorize the arrest of persons violating the provisions of this act, and to prescribe the penalty therefor," by amending section 6 and by adding section 5a; and to provide for a referendum. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 SEC. 5A. (1) SECTION 1 DOES NOT APPLY TO A PERSON ENGAGED 2 IN THE PRODUCTION OF LIVESTOCK ON A PARCEL OF LAND IN THE COUNTY 3 OF LENAWEE, OR HIS OR HER DESIGNEE, IF THE PERSON OR DESIGNEE IS 4 IN POSSESSION OF A SUNDAY HUNTING EXEMPTION PERMIT ISSUED UNDER 5 SUBSECTION (2) AND IS HUNTING PREDATORS OF THAT TYPE OF LIVESTOCK 6 ON THAT PARCEL OR ON A CONTIGUOUS PARCEL OWNED OR LEASED BY THAT 7 PERSON OR BY AN IMMEDIATE FAMILY MEMBER OF THAT PERSON. 8 (2) A PERSON ENGAGED IN THE PRODUCTION OF LIVESTOCK IN THE 9 COUNTY OF LENAWEE MAY SUBMIT TO THE DEPARTMENT OF NATURAL 02995'99 TMV 2 1 RESOURCES A WRITTEN REQUEST FOR A SUNDAY HUNTING EXEMPTION 2 PERMIT. UPON VERIFYING THAT THE PERSON IS ENGAGED IN THE PRODUC- 3 TION OF LIVESTOCK IN THE COUNTY OF LENAWEE, THE DEPARTMENT SHALL 4 ISSUE A SUNDAY HUNTING EXEMPTION PERMIT. A SUNDAY HUNTING EXEMP- 5 TION PERMIT IS VALID FOR 1 YEAR BUT MAY BE REISSUED. 6 Sec. 6.The wordAS USED IN THIS ACT: 7 (A) "IMMEDIATE FAMILY MEMBER" MEANS AN INDIVIDUAL'S SPOUSE, 8 FATHER, MOTHER, FATHER-IN-LAW, MOTHER-IN-LAW, CHILD, STEPCHILD, 9 SIBLING, OR HALF SIBLING. 10 (B) "LIVESTOCK" MEANS THAT TERM AS DEFINED IN THE ANIMAL 11 INDUSTRY ACT OF 1987, 1988 PA 466, MCL 287.701 TO 287.747. 12 (C) "Sunday"as used in this act shall be construed to13meanMEANS the first day of the week. 14 Enacting section 1. (1) This amendatory act does not take 15 effect unless approved by a majority of the electors of the 16 county of Lenawee voting on the question. The question of 17 approval of this act shall be submitted to the qualified electors 18 of the county of Lenawee at the next regular election to be held 19 not less than 60 days after the effective date of this act, or at 20 a special election called for that purpose by the county board of 21 commissioners of the county of Lenawee. The question shall be 22 submitted in substantially the following form: 23 "Shall 1999 Local Act ______, which would amend 1931 LA 1 to 24 permit persons engaged in thecommercialproduction of live- 25 stock to hunt predators on Sunday under certain circumstances in 26 Lenawee county, be adopted? 02995'99 3 1 Yes ( ) 2 No ( )". 3 (2) If a majority of the qualified electors voting on the 4 question vote in favor of the adoption of this amendatory act, 5 this amendatory act takes effect 10 days following the certifica- 6 tion of the election results. 02995'99 Final page.
