        A bill to amend 1931 PA 328, entitled

   "The Michigan penal code,"

   by amending section 239 (MCL 750.239).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 239.  (1)  All pistols, weapons or devices  EXCEPT AS

 2    PROVIDED IN SUBSECTION (2), A PISTOL, WEAPON, OR DEVICE carried,

 3    possessed, or used  contrary to  IN VIOLATION OF this chapter

 4     are hereby declared  IS forfeited to the state  ,  and shall be

 5    turned over to the  commissioner  DIRECTOR of the  Michigan 

 6    DEPARTMENT OF state police or his OR HER designated representa-

 7    tive, for  such  disposition as the  commissioner may prescribe 

 8    DIRECTOR OF THE DEPARTMENT OF STATE POLICE PRESCRIBES.

 9         (2) A CONCEALED PISTOL CARRIED IN VIOLATION OF THIS CHAPTER

10    BY AN INDIVIDUAL LICENSED TO CARRY A CONCEALED PISTOL UNDER

 1    SECTION 5B OF 1927 PA 372, MCL 28.425B, IS SUBJECT TO SEIZURE AND

 2    FORFEITURE UNDER SECTION 5G OF 1927 PA 372, MCL 28.425G.

 3         Enacting section 1.  This amendatory act takes effect

 4    September 30, 1999.

 5         Enacting section 2.  This amendatory act does not take

 6    effect unless Senate Bill No. ______ or House Bill No. ______

 7    (request no. 00486'99 ***) of the 90th Legislature is enacted

 8    into law.
