        A bill to amend 1931 PA 328, entitled

   "The Michigan penal code,"

   by amending section 357b (MCL 750.357b), as added by 1990 PA

   321.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 357b.  (1) A person who commits larceny by stealing the

 2    firearm of another person is guilty of a felony  ,  punishable by

 3    imprisonment for not LESS THAN 5 YEARS OR more than  5  15 years

 4    or  by  a fine of not more than $2,500.00, or both.

 5         (2) A PERSON WHO POSSESSES A FIREARM KNOWING OR HAVING

 6    REASON TO KNOW THE FIREARM WAS STOLEN IN VIOLATION OF SUBSECTION

 7    (1) IS GUILTY OF A FELONY PUNISHABLE BY IMPRISONMENT FOR NOT LESS

 8    THAN 5 YEARS OR MORE THAN 15 YEARS OR A FINE OF NOT MORE THAN

 9    $2,500.00, OR BOTH.

 1         Enacting section 1.  This amendatory act takes effect

 2    September 30, 1999.

 3         Enacting section 2.  This amendatory act does not take

 4    effect unless Senate Bill No. _____ or House Bill No. _____

 6    into law.
