HOUSE BILL No. 4628


     May 4, 1999, Introduced by Reps. Vander Roest, DeRossett, Gosselin, Tabor, Jamnick, Lockwood, Bishop, Ehardt, Garcia and Scranton and referred to the Committee on Local Government and Urban Policy.


        A bill to amend 1959 PA 168, entitled

   "An act to provide for township planning; for the creation,
   organization, powers and duties of township planning commissions;
   and for the regulation and subdivision of land,"

   by amending section 9 (MCL 125.329).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 9.  (1) Before the adoption of the plan or any part,

 2    amendment, extension, or addition TO THE PLAN, the planning com-

 3    mission shall hold at least 1 public hearing thereon.  Thirty

 4     days' notice of public hearing shall be given by 2 publications

 5     at least 2 weeks apart and not less than 7 days before the hear-

 6     ing in a newspaper having a general circulation in the township. 

 7    THE PLANNING COMMISSION SHALL GIVE NOTICE OF THE HEARING BY 2

 8    PUBLICATIONS IN A NEWSPAPER OF GENERAL CIRCULATION IN THE

 9    TOWNSHIP, THE FIRST NOT MORE THAN 30 DAYS OR LESS THAN 20 DAYS

 1    AND THE SECOND NOT MORE THAN 8 DAYS BEFORE THE DATE OF THE

 2    HEARING.

 3         (2) Following the adoption of the basic plan or any part

 4    thereof by the planning commission, THE PLANNING COMMISSION SHALL

 5    TRANSMIT copies of the plan  shall be transmitted  to the town-

 6    ship board and to the county planning commission of the county of

 7    which the township is a part,  and  OR, if there is no county

 8    planning commission,  then  to the regional planning commission

 9     which  THAT is exercising planning jurisdiction over the

10    township.
