        A bill to amend 1979 PA 218, entitled

   "Adult foster care facility licensing act,"

   by amending section 15 (MCL 400.715), as amended by 1984 PA 40.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 15.  (1)  The  EXCEPT AS PROVIDED IN
             SUBSECTION (2),

 2    THE department shall not issue a temporary license to an adult

 3    foster care congregate facility, except a facility  which
              THAT

 4    MEETS ALL OF THE FOLLOWING REQUIREMENTS:

 5         (A) THE FACILITY is to replace an adult foster care congre-

 6    gate facility licensed on March 27, 1984 and is a new

 7    construction.  ; 

 8         (B) THE FACILITY satisfies all applicable state construction

 9    code requirements and the fire safety requirements prescribed by

10    section 20.  ; and the

 1         (C) THE bed capacity does not exceed that of the licensed

 2    facility  which  THAT it replaces.

 3         (2) THE DEPARTMENT MAY ISSUE A TEMPORARY ADULT FOSTER CARE

 4    CONGREGATE FACILITY LICENSE TO THE 2 COUNTY INFIRMARIES IN EXIS-

 5    TENCE IN THIS STATE ON THE EFFECTIVE DATE OF THE AMENDATORY ACT

 6    THAT ADDED THIS SUBSECTION.
