A bill to amend 1949 PA 300, entitled "Michigan vehicle code," by amending section 707e (MCL 257.707e). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 707e. (1) Test instrumentation and procedures used 2 for implementation and enforcement of sections 707a to 707d shall 3 substantially conform with applicable standards and recommended 4 practices established by the society of automotive engineers, 5 inc., and the American national standards institute, inc., for 6 the measurement of motor vehicle sound levels. Rules establish- 7 ing these test procedures shall be promulgated by the STATE 8 TRANSPORTATION department. of state highways and 9 transportation. The rules may provide for measurement at other 10 than the distance specified in section 707c , provided that 11 ONLY IF the decibel limits applied at the other distances are 05756'00 JJG 2 1 adjusted accordingly , to meet the standards in section 707c. 2 The rules shall be promulgated pursuant to Act No. 306 of the 3 Public Acts of 1969, as amended, being sections 24.201 to 24.315 4 of the Michigan Compiled Laws THE ADMINISTRATIVE PROCEDURES ACT 5 OF 1969, 1969 PA 306, MCL 24.201 TO 24.328. 6 (2) This EXCEPT AS PROVIDED IN SUBSECTION (3), THIS act 7 occupies the whole field of vehicle noise regulation. A city, 8 county, village, or township shall not adopt or enforce vehicle 9 noise rules unless the rules are identical to the requirements of 10 this act. 11 (3) A CITY, COUNTY, VILLAGE, OR TOWNSHIP MAY ENACT AN ORDI- 12 NANCE THAT PRESCRIBES LEVELS OF SOUND PRODUCED BY A RADIO, 13 STEREO, OR OTHER ELECTRONIC SOUND EQUIPMENT IN A MOTOR VEHICLE. 05756'00 Final page.
