HOUSE BILL No. 5788 May 16, 2000, Introduced by Reps. DeHart, Schermesser, Cherry, Hale, Hardman, Scott and Rivet and referred to the Committee on Family and Civil Law. A bill to require public bathroom facilities in retail establishments; to prescribe powers and duties of certain state officials and agencies; and to prescribe penalties. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. As used in this act: 2 (a) "Retailer" means a person who sells or offers to sell 3 consumer goods to the general public. 4 (b) "Retail establishment" means a place of business of a 5 retailer, all or part of which is open to the general public. 6 Retail establishment does not include a place of business of a 7 retailer not open to the general public. 8 Sec. 2. A retailer shall provide bathroom facilities for 9 use by the general public in each retail establishment during 10 business hours. If separate bathroom facilities are not provided 11 for men and women, the retailer shall provide a unisex bathroom. 04864'99 DAM 2 1 The bathroom facilities shall meet the barrier free design 2 requirements contained in the Stille-DeRossett-Hale single state 3 construction code act, 1972 PA 230, MCL 125.1501 to 125.1531. 4 Sec. 3. (1) A retailer who violates this act is guilty of a 5 misdemeanor punishable by a fine of not more than $500.00. Each 6 day a violation continues is a separate offense. 7 (2) The attorney general or a prosecuting attorney of a 8 county may bring an action in a court of competent jurisdiction 9 to prevent a violation of this act or to compel a retailer to 10 perform a duty imposed on the retailer under this act. 11 Enacting section 1.
