A bill to amend 1966 PA 331, entitled "Community college act of 1966," by amending sections 31 and 32 (MCL 389.31 and 389.32). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 31. (1) A school district or 2 or more contiguous 2 school districts which THAT operate grades kindergarten through 3 12 may form a community college district UNDER THIS CHAPTER. 4 When resolutions of 5 (2) IF the boards of education of contiguous school dis- 6 tricts EACH ADOPT A RESOLUTION requesting the organization of the 7 community college district are filed AND FILE THE RESOLUTIONS 8 with the secretary of the board of education of the intermediate 9 school district having the highest valuation in the proposed 10 community college district area, he OR SHE shall refer the 11 questions of organizing the community college district and the 06644'00 DAM 2 1 proposed annual tax rate to the state board of education for 2 approval. When 3 (3) IF the board of education of a single school district 4 adopts a resolution OR RECEIVES A PETITION SIGNED BY NOT LESS 5 THAN 500 SCHOOL ELECTORS OF THE SCHOOL DISTRICT requesting the 6 organization of a community college district, the secretary of 7 the board of education of that THE district shall refer such 8 THE questions OF ORGANIZING THE COMMUNITY COLLEGE DISTRICT AND 9 THE PROPOSED ANNUAL TAX RATE to the state board of education for 10 approval. 11 (4) (2) For the purpose of this chapter, a school district 12 operating grades kindergarten through 12 shall be IS eligible 13 for the formation of a community college district even though a 14 part of the district is within an existing community college 15 district. Except as provided in section 46, the part shall not 16 be WITHIN AN EXISTING COMMUNITY COLLEGE DISTRICT IS NOT included 17 in the area of the community college district nor shall AND a 18 person residing in the THAT part be IS NOT eligible to vote 19 at the organizational election or at any community college dis- 20 trict election. 21 Sec. 32. (1) In the case IF THE PROPOSED COMMUNITY COL- 22 LEGE DISTRICT IS COMPRISED of 2 or more CONTIGUOUS school 23 districts, AND IF THE STATE BOARD OF EDUCATION GRANTS ITS 24 APPROVAL AS DESCRIBED IN SECTION 31(2), the secretary of the 25 board of education of the intermediate school district shall file 26 a copy of the approval specified in section 31 with the 27 secretary of the board of education of each component school 06644'00 3 1 district. When IF the filing or receipt of approval from the 2 state board of education by the secretary of the board of educa- 3 tion of a single school district occurs at least 60 days but not 4 more than 6 months prior to the next annual school election, the 5 secretaries SECRETARY OF THE BOARD OF EDUCATION OF EACH COMPO- 6 NENT SCHOOL DISTRICT shall include the necessary community col- 7 lege propositions in the proceedings for the annual election. 8 (2) When the approval is filed with the secretaries of the com- 9 ponent school districts or approval is received by the secretary 10 of the board of education of a single school district IF THE 11 FILING OCCURS more than 6 months prior to BEFORE the date of 12 the NEXT annual school election, each THE board of education OF 13 EACH COMPONENT SCHOOL DISTRICT shall call a special election to 14 be held on a date designated by the secretary of the intermediate 15 board of education of the school district having the highest val- 16 uation within the proposed community college district , for the 17 purpose of submitting the propositions relating to the establish- 18 ment of a community college district. , or in the case of a 19 single school district the board of education shall call a spe- 20 cial election on a date it determines. A majority of the elec- 21 tors of the EACH COMPONENT school district voting thereon 22 shall ON THE PROPOSITIONS MUST approve the organization of the 23 community college district. 24 (2) IF THE PROPOSED COMMUNITY COLLEGE DISTRICT IS COMPRISED 25 OF 1 SCHOOL DISTRICT, AND IF THE STATE BOARD OF EDUCATION GRANTS 26 ITS APPROVAL AS DESCRIBED IN SECTION 31(3), THE SECRETARY OF THE 27 BOARD OF EDUCATION OF THE SCHOOL DISTRICT SHALL INCLUDE THE 06644'00 4 1 NECESSARY COMMUNITY COLLEGE PROPOSITIONS IN THE PROCEEDINGS FOR 2 THE NEXT ANNUAL SCHOOL ELECTION IF THE SECRETARY RECEIVES THE 3 APPROVAL AT LEAST 60 DAYS BUT NOT MORE THAN 6 MONTHS BEFORE THE 4 ANNUAL SCHOOL ELECTION. IF THE SECRETARY RECEIVES THE APPROVAL 5 MORE THAN 6 MONTHS PRIOR TO THE DATE OF THE NEXT ANNUAL SCHOOL 6 ELECTION, THE BOARD OF EDUCATION OF THE SCHOOL DISTRICT SHALL 7 CALL A SPECIAL ELECTION ON A DATE IT DETERMINES, BUT NOT MORE 8 THAN 90 DAYS AFTER RECEIVING THE APPROVAL. A MAJORITY OF THE 9 ELECTORS OF THE SCHOOL DISTRICT VOTING ON THE PROPOSITIONS MUST 10 APPROVE THE ORGANIZATION OF THE COMMUNITY COLLEGE DISTRICT. 06644'00 Final page. DAM
