A bill to amend 1931 PA 328, entitled "The Michigan penal code," by amending section 508 (MCL 750.508), as amended by 1990 PA 77. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 508. (1) Any person who shall equip a vehicle with a 2 radio receiving set that will receive signals sent on frequencies 3 assigned by the federal communications commission of the United 4 States of America for police purposes, or use the same in this 5 state unless such vehicle is used or owned by a peace officer, or 6 a bona fide amateur radio operator holding a technician class, 7 general, advanced, or extra class amateur license issued by the 8 federal communications commission, without first securing a 9 permit so to do from the director of the department of state 10 police upon application as he or she may prescribe, shall be 11 guilty of a misdemeanor, punishable by imprisonment in the county 06295'00 JJG 2 1 jail for not more than 1 year, or by a fine of not more than 2 $500.00, or by both fine and imprisonment in the discretion of 3 the court. 4 (2) This section shall not be construed as restricting the 5 use of radar detectors. 6 (1) EXCEPT AS PROVIDED IN SUBSECTION (2), A PERSON SHALL NOT 7 EITHER EQUIP A VEHICLE WITH A RADIO RECEIVER, OR POSSESS IN A 8 VEHICLE A PORTABLE RADIO RECEIVER, THAT RECEIVES RADIO FREQUEN- 9 CIES ASSIGNED BY THE FEDERAL COMMUNICATIONS COMMISSION FOR POLICE 10 PURPOSES. 11 (2) SUBSECTION (1) DOES NOT APPLY TO A VEHICLE OWNED OR USED 12 BY AN INDIVIDUAL WHO HAS OBTAINED A VALID PERMIT FROM THE DIREC- 13 TOR OF THE DEPARTMENT OF STATE POLICE ON A FORM PRESCRIBED BY THE 14 DIRECTOR AND WHO IS EITHER OF THE FOLLOWING: 15 (A) A LAW ENFORCEMENT OFFICER CERTIFIED PURSUANT TO THE COM- 16 MISSION ON LAW ENFORCEMENT STANDARDS ACT, 1965 PA 203, MCL 28.601 17 TO 28.616. 18 (B) AN AMATEUR RADIO OPERATOR LICENSED BY THE FEDERAL COMMU- 19 NICATIONS COMMISSION IN 1 OF THE FOLLOWING CLASSES: 20 (i) TECHNICIAN CLASS. 21 (ii) TECHNICIAN PLUS CLASS. 22 (iii) GENERAL CLASS. 23 (iv) ADVANCED OPERATOR CLASS. 24 (v) AMATEUR EXTRA OPERATOR CLASS. 25 (3) THIS SECTION DOES NOT RESTRICT OR PROHIBIT EQUIPPING A 26 VEHICLE WITH OR USING A RADAR DETECTOR. 06295'00 3 1 (4) A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A 2 MISDEMEANOR PUNISHABLE BY IMPRISONMENT FOR NOT MORE THAN 1 YEAR 3 OR BY A FINE OF NOT MORE THAN $500.00, OR BOTH. 06295'00 Final page.
