A bill to amend 1937 PA 284, entitled "An act to prevent the spread of infectious and contagious dis- eases of livestock; to require persons, associations, partner- ships and corporations engaged in the buying, receiving, selling, transporting, exchanging, negotiating, or soliciting sale, resale, exchange or transportation of livestock to be licensed and bonded by the department of agriculture; to keep a producers' proceeds account; to provide for the refusal, suspension or revo- cation of such licenses; to provide for weighmasters; to provide for the inspection and disinfection of yards, premises and vehi- cles; and to provide penalties for the violation of this act," by amending section 1 (MCL 287.121). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 1. (1) (a) "Department" as used in this act shall 2 mean MEANS the Michigan state department of agriculture. 3 (2) (b) "Director" as used in this act means the direc- 4 tor of the department. of agriculture. 02784'99 c LBO 2 1 (3) (c) "Animals" or "livestock" as used in this act 2 shall mean and include MEANS AND INCLUDES horses, ponies, mules, 3 cattle, FARMED CERVIDAE, calves, swine, sheep, and goats. 4 (4) (d) "Dealer" or "broker" as used in this act shall 5 mean MEANS any person, copartnership, association, or corpora- 6 tion engaged in the business of buying, receiving, selling, 7 exchanging, transporting, negotiating, or soliciting sale, 8 resale, exchange, transportation, or transfer of any such 9 animals. , but it shall not be construed to include: (1) any 10 DEALER OR BROKER DOES NOT INCLUDE ANY OF THE FOLLOWING: 11 (A) A railroad or air line AIRLINE transporting animals 12 either interstate or intrastate. ; (2) any 13 (B) A person, association, copartnership, or corporation who 14 or which, by dispersal sale, is permanently discontinuing the 15 business of farming, dairying, breeding, or feeding animals. ; 16 (3) any 17 (C) A person, association, copartnership, or corporation 18 that sells livestock which has been raised on the premises of 19 such person, association, copartnership, or corporation. ; (4) 20 any 21 (D) A butcher, packer, or processor to whom animals are 22 delivered and used exclusively for slaughter, or that part of the 23 business of a farmer which consists CONSISTING of buying or 24 receiving animals for breeding, grazing, and feeding purposes and 25 the sale or disposal of such animals after the feeding or grazing 26 period of not less than 21 days. ; (5) terminal 02784'99 c 3 1 (E) TERMINAL livestock markets where agricultural research 2 service of the United States department of agriculture veterinary 3 inspection is daily maintained. ; (6) occasionally 4 (F) OCCASIONALLY held consignment sales such as breed, 4-H, 5 or F.F.A. sales. 6 (5) (e) "Agent" as used in this act shall mean MEANS any 7 person, firm, association, copartnership, or corporation buying, 8 receiving, selling, exchanging, transporting, negotiating, or 9 soliciting sale, resale, exchange, transportation, or transfer of 10 any animals for or on behalf of any dealer or broker. 11 (6) (f) "Livestock auction" as used in this act shall 12 mean MEANS any livestock market where livestock is accepted on 13 consignment and the auction method is used in the marketing of 14 such livestock. A LIVESTOCK AUCTION DOES NOT INCLUDE A public 15 auction of farm goods by a farmer. is not included in this defi- 16 nition of a livestock auction. 17 (7) (g) "Weighmaster" as used in this act shall mean 18 MEANS any person registered under this act who weighs livestock 19 at any livestock market licensed under this act. 20 Enacting section 1.
