SENATE BILL No. 1331

Local, Urban and State Affairs.

A bill to amend 1951 PA 33, entitled

"An act to provide police and fire protection for townships and

for certain areas in townships, certain incorporated villages,

and cities under 15,000 population; to authorize contracting for

fire and police protection; to authorize the purchase of fire and

police equipment, and the maintenance and operation of the equip-

ment; to provide for defraying the cost of the equipment; to

authorize the creation of special assessment districts and the

levying and collecting of special assessments; to authorize the

issuance of special assessment bonds in anticipation of the col-

lection of special assessments and the advancement of the amount

necessary to pay such bonds, and to provide for reimbursement for

such advances by reassessment if necessary; to authorize the col-

lection of fees for certain emergency services in townships and

other municipalities; to authorize the creation of administrative

boards and to prescribe their powers and duties; to provide for

the appointment of traffic officers and to prescribe their powers

and duties; and to repeal certain acts and parts of acts,"

by amending section 5 (MCL 41.805).

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1 Sec. 5. The township board of any A township , where

2 appropriations have been made as herein provided , shall have

3 power to UNDER THIS ACT MAY enact such ordinances and

1 establish and enforce such resolutions as they shall deem

2 CONSIDER necessary to guard against the occurrence of fires and

3 to protect the property and persons of the citizens against

4 damage and accident resulting therefrom FROM FIRES. Any town-

5 ship adopting ordinances under the provisions of this section

6 shall have the power to adopt any standard fire prevention code

7 which has been promulgated by the state or by any department,

8 board or agency thereof, or by any national organization or asso-

9 ciation which is organized and conducted for the purpose of

10 developing such codes with specific date of publication by refer-

11 ence thereto in an adopting ordinance and without publishing such

12 code in full. The code shall be clearly identified in the ordi-

13 nance and the purpose of the code shall be published with the

14 adopting ordinance and printed copies shall be kept in the office

15 of the township clerk, available for inspection by and distribu-

16 tion to the public at all times. The publication shall contain a

17 notice to the effect that a complete copy of the code is avail-

18 able for public use and inspection at the office of the township

19 clerk. A TOWNSHIP MAY BY ORDINANCE ADOPT A FIRE CODE AS PROVIDED

20 UNDER 1945 PA 246, MCL 41.181 TO 41.187.

21 Enacting section 1. This amendatory act does not take

22 effect unless Senate Bill No. 1330

23 of the 90th Legislature is enacted into

24 law.
