ADDENDUM TO SENATE FISCAL AGENCY ANALYSIS OF SENATE BILL 380 DATED 4-10-02:

HOUSE COMMITTEE ACTION:

The House Commerce Committee reported a substitute version that differs from the Senate-passed bill in two major ways. First, the House substitute does not apply to shopping centers. It applies only to an entertainment forum. Second, the Senate version had specified that the provisions protecting an entertainment forum from a civil action for damages would not apply if the entertainment forum used "excessive force" against an individual. The House substitute would say the provisions would not apply if the entertainment forum used "unreasonable force". The substitute also has differently numbered sections.

POSITIONS:

The National Association of Theater Owners/Michigan Chapter has indicated support for Senate Bill 380. (12-3-02)

The Michigan Trial Lawyers Association does not support the bill. (12-3-02)

The Negligence Section of the State Bar of Michigan is opposed to the bill. (12-2-02)
