A SUMMARY OF HOUSE BILL 4423 AS INTRODUCED 3-7-01

 

Under Article 20 of the Occupational Code, entitled "Architects, Professional Engineers, and Land Surveyors," a person who is not licensed as one of the above professionals is exempt from the article's requirements if the person is planning, designing, or directing the construction of a residential building up to 3,500 square feet of calculated floor area. The bill would increase the square footage allowed under the exemption from 3,500 to 5,000 square feet of calculated floor area.

Further, the code currently defines "calculated floor area" as the habitable area of a building that is measured to the outside surfaces of exterior walls. It includes a heater or utility room, but does not include a crawl space; a garage, open porch, balcony, terrace, or court; or an unfinished and nonhabitable portion of a basement or attic. The bill would amend the section of this definition pertaining to basements and attics to simply refer to a basement or attic, regardless of whether it is finished or habitable.
