A SUMMARY OF HOUSE BILL 5223 AS INTRODUCED 10-16--01

The Revised Judicature Act allows a property owner to initiate summary proceedings to recover possession of his or her property when a tenant remains on the property seven days after the landlord has served the tenant a written notice to quit, under certain circumstances. For example, eviction is allowed for failure to pay the rent; after the lease has been terminated; or for unlawful possession of a controlled substance. House Bill 5223 would reduce the time at which eviction action may be filed, from seven days to one day, in each of these circumstances.
