A SUMMARY OF HOUSE BILL 5307 AS INTRODUCED 10-23-01
House Bill 5307 would amend the Elliot-Larsen Civil Rights Act to authorize the state Civil Rights Commission to issue orders in response to violations of the "Michigan Racial Profiling and Report Statistics Act", proposed by House Bill 4927. Currently the civil rights act requires the state Civil Rights Commission, upon hearing a charge issued by the state Department of Civil Rights and determining that a respondent has violated either the civil rights act or the Persons with Disabilities Civil Rights Act, to order the respondent to stop the practice and take any other actions necessary to secure equal enjoyment and protection of civil rights. The bill would authorize the civil rights commission to issue such orders in the case of violations of the Michigan Racial Profiling and Report Statistics Act, which would prohibit "racial profiling", defined as the detention or other disparate treatment of an individual on the basis of his or her racial or ethnic status. House Bill 5307 is tie-barred to House Bill 4927.
