A SUMMARY OF HOUSE BILL 5961 AS INTRODUCED 4-25-02
The bill would amend Part 93 of the Natural Resources and Environmental Protection Act (Public Act 451 of 1994). Under Part 93, a soil conservation district is permitted to acquire property or the rights or interest in property; maintain, administer, and improve any properties acquired; receive income from those properties acquired; and to sell, lease, or otherwise dispose of any its property or interests in property. The bill would add that a conservation district would be permitted to retain any property, or rights in property, that it acquires under Part 93. In addition, a conservation district could establish a foundation or separate account to receive property, and could also apply for designation under federal law for contributions to be granted beneficial tax treatment.
