Currently, the Code lists the penalties for first, second, and subsequent violations of Section 83 of the Code, which prohibits a person from operating a civil aircraft over or upon the lands and waters of the State unless he or she is complying with the Federal Airman Certification requirements under the Code of Federal Regulations. In addition, the Aeronautics Code details the penalties for violating Section 83b, which prohibits a person from conducting flight operations requiring a Federal aviation regulation air carrier or commercial operator's certification, without first having been issued a valid Federal aviation regulation air carrier or operating certificate or valid commercial operator's certificate. Under the bill, second or subsequent violations following a prior conviction under Section 83 or 83b would result in the penalties established in the Code.
