HOUSE BILL No. 4618 April 18, 2001, Introduced by Reps. Van Woerkom, Kuipers, Bradstreet, Shackleton, Vander Veen and Voorhees and referred to the Committee on Education. A bill to amend 1979 PA 94, entitled "The state school aid act of 1979," by amending section 32g (MCL 388.1632g), as added by 2000 PA 297. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 32g. (1) From the state school aid fund allocation 2 under section 32a(1), there is allocated an amount not to exceed 3 $38,000,000.00 each fiscal year for 2000-2001 and for 2001-2002, 4 and an amount not to exceed $50,000,000.00 for 2002-2003 for pay- 5 ments to districts to provide summer school instruction in read- 6 ing and mathematics for pupils in grade 1, 2, 3, or 4. 7 (2) In order to improve elementary school pupil achievement, 8 districts may provide summer school instruction in reading and 9 mathematics. The department shall develop a model summer 10 mathematics program for pupils who attended grade 1, 2, 3, or 4 03566'01 TAV 2 1 in the school year that just ended and who have demonstrated the 2 need for additional mathematics skills training, as evidenced by 3 standardized test results on tests approved by the department for 4 this purpose. The model mathematics program shall be in con- 5 formance with the national education goals and shall also meet 6 criteria for DED-OESE, title I program funding. 7 (3) To be eligible to participate in summer school instruc- 8 tion funded under this section during a particular summer, a 9 pupil shall have been enrolled in grade 1, 2, 3, or 4 in the 10 school year that just ended and shall meet at least 1 of the fol- 11 lowing criteria: 12 (a) Achieved less than satisfactory results, as determined 13 by the district, in the mathematics or reading portion of a 14 department-approved annual standardized assessment of 15 grade-appropriate basic educational skills. 16 (b) Scored in the low performance category of the mathemat- 17 ics or reading portion of the grade 4 Michigan education assess- 18 ment program (MEAP) test. 19 (4) An application for funding under this section shall be 20 submitted to the department for approval, in a manner and on 21 forms prescribed by the department, by a date specified by the 22 department. 23 (5)ASUBJECT TO SUBSECTION (7), A district that receives 24 funding under this section shall, at a minimum, offer summer 25 school instruction under this section for pupils who were 26 enrolled in grade 3 in the school year that just ended and met 27 the criteria described in subsection (3)(a). 03566'01 3 1 (6)ASUBJECT TO SUBSECTION (7), A district that receives 2 funding under this section shall provide a minimum of 6 weeks of 3 pupil instruction under this section in mathematics and reading. 4 In addition, applications for funding may include the provision 5 of auxiliary services by the district in a manner determined by 6 the district for such services as school lunch and transportation 7 as is necessary to encourage pupil participation. 8 (7) A DISTRICT THAT RECEIVES FUNDING UNDER THIS SECTION MAY 9 USE SOME OR ALL OF THE FUNDS TO PROVIDE BEFORE-SCHOOL OR 10 AFTER-SCHOOL PROGRAMS DESIGNED TO ASSIST PUPILS TO MEET STANDARDS 11 FOR BASIC LITERACY SKILLS OR FOR BASIC MATHEMATIC SKILLS, AS 12 DESCRIBED IN SECTION 1282A OF THE REVISED SCHOOL CODE, MCL 13 380.1282A, BEFORE THE END OF THE SCHOOL YEAR. THESE PROGRAMS 14 SHALL BE FOR PUPILS ENROLLED IN GRADE 1, 2, 3, OR 4 WHO MEET AT 15 LEAST 1 OF THE CRITERIA UNDER SUBSECTION (3)(A) OR (B). 16 (8)(7)A district applying for funding under this section 17 must identify money from other sources available to the district 18 that will be used to support at least 50% of the total costs of 19 thesummer schoolprogram. 20 (9)(8)Grant awards under this section shall be distrib- 21 uted in accordance with the following: 22 (a) Eighty percent of the amount provided to a grant recipi- 23 ent shall be based on enrollment of eligible participants. 24 (b) Twenty percent of the amount provided to a grant recipi- 25 ent shall be based on measured improvement in reading or mathe- 26 matics, as applicable. 03566'01 4 1 (10)(9)Funds allocated to a district under this section 2 shall not be used to supplant other state or federal funds 3 allocated to the district for similar purposes. 4 (11)(10)Subject to program capacity, a pupil who was 5 enrolled in grade 1, 2, 3, or 4 in the school year that just 6 ended but who does not otherwise meet the eligibility criteria 7 under this section may receive summer school instruction 8 described in this section upon the payment of tuition. The 9 tuition level shall be determined by the district but shall not 10 exceed actual operating costs. 11 (12)(11)A district receiving funding under this section 12 shall report on the results achieved by the summer school 13 program, OR BEFORE-SCHOOL OR AFTER-SCHOOL PROGRAM, in a manner 14 prescribed by the department. At a minimum, the grant recipient 15 shall report to the department by October 15 regarding the 16 program's impact on reducing the number of pupils requiring spe- 17 cial education programs and services and on improving pupil 18 scores on standardized tests and assessments, and information on 19 the costs and benefits per unit of pupil improvement. In addi- 20 tion, the report shall state the number of pupils eligible for 21 free or reduced price school lunch who received services under 22 the program and the total number of pupils who received services 23 under the program. Not later than November 15 of each fiscal 24 year, the department shall submit a report to the legislature, 25 the state budget director, and the senate and house fiscal agen- 26 cies detailing the results of the programs. 03566'01 5 1 (13)(12)Beginning in 2000-2001, notwithstanding section 2 17b, payments under this section shall be paid on a schedule 3 determined by the department. 4 (14)(13)Districts may form consortia or enter into coop- 5 erative arrangements for operating programs and obtaining funding 6 under this section. 7 (15)(14)Funds allocated under this section that are not 8 expended in the state fiscal year for which they were allocated 9 may be carried forward to a subsequent state fiscal year. 03566'01 Final page.
