A bill to amend 1954 PA 116, entitled "Michigan election law," by amending section 47 (MCL 168.47). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 47. (1) The electors of president and vice-president 2 shall convene in the senate chamber at the STATE capitol of the 3 state at 2 p.m. , eastern standard time, on the first Monday 4 after the second Wednesday in December following their election. 5 At any time before receipt of the certificate of the governor or 6 within 48 hours thereafter AFTER RECEIPT, an elector may resign 7 by submitting his OR HER written and verified resignation to the 8 governor. Failure to so resign signifies consent to serve and 9 to cast his OR HER vote for the candidates for president and 10 vice-president appearing on the Michigan ballot of the political 11 party which nominated him THE ELECTOR. 02795'01 CAS 2 1 (2) Refusal or failure IF THE ELECTOR REFUSES OR FAILS to 2 vote for the candidates for president and vice-president appear- 3 ing on the Michigan ballot of the political party which THAT 4 nominated the elector, ALL OF THE FOLLOWING SHALL OCCUR: 5 (A) IT constitutes a THE ELECTOR'S resignation from the 6 office of elector. , his 7 (B) THE ELECTOR'S vote shall not be recorded. and the 8 (C) THE remaining electors shall forthwith IMMEDIATELY 9 fill the vacancy. 10 (D) THE ELECTOR SHALL BE FINED $1,000.00. 11 (3) The ballot used by the elector shall bear the name of 12 the elector. If at the time of convening there is any A 13 vacancy caused by death, resignation, refusal or failure to vote, 14 neglect FAILURE to attend, or ineligibility of any A person 15 elected, or for any other ANOTHER cause, the qualified electors 16 of president and vice-president shall proceed to fill such 17 THE vacancy by ballot, by a plurality of votes. When all the 18 electors appear and the vacancy shall be IS filled, they shall 19 proceed to perform the duties of such electors, as required 20 by the constitution and laws of the United States.
