HOUSE BILL No. 5116 October 2, 2001, Introduced by Rep. Quarles and referred to the Committee on Redistricting and Elections. A bill to amend 1954 PA 116, entitled "Michigan election law," by amending sections 523 and 744 (MCL 168.523 and 168.744), sec- tion 523 as amended by 1996 PA 583 and section 744 as amended by 1995 PA 261. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 523. (1) At each election, before being given a 2 ballot, each registered elector offering to vote shall identify 3 himself or herself bypresenting an official state identifica-4tion card issued to that individual pursuant to Act No. 222 of5the Public Acts of 1972, being sections 28.291 to 28.295 of the6Michigan Compiled Laws, an operator's or chauffeur's license7issued to that individual pursuant to the Michigan vehicle code,8Act No. 300 of the Public Acts of 1949, being sections 257.1 to9257.923 of the Michigan Compiled Laws, or other generally04883'01 CAS 2 1recognized picture identification card and byexecuting an 2 application showing his or her signature or mark and address of 3 residence in the presence of an election official. If the voter 4 registration cards are used in the precinct, the election offi- 5 cial in charge of the precinct registration file shall compare 6 the signature upon the application with the signature upon the 7 registration card. If voter registration lists are used in the 8 precinct, the electioninspectorOFFICIAL shall determine if 9 the name on the application to vote appears on the voter regis- 10 tration list. If the name appears on the voter registration 11 list, the elector shall provide further identification by giving 12 his or her date of birth or other information stated upon the 13 voter registration list. In precincts using voter registration 14 lists, the date of birth may be required to be placed on the 15 application to vote. If the signature or an item of information 16 does not correspond, the vote of the person shall be challenged 17, and the same procedure shall be followedas providedin this18act for the challenging of an electorUNDER SECTION 727. If the 19 person offering to vote has signed the registration card or 20 application by making a mark, the person shall identify himself 21 or herself by giving his or her date of birth, which shall be 22 compared with the date of birth stated upon the registration card 23 or voter registration list, or shall give other identification 24as may beTHAT IS referred to upon the registration card or 25 voter registration list.If the elector does not have an offi-26cial state identification card, operator's or chauffeur's license27as required in this subsection, or other generally recognized04883'01 3 1picture identification card, the individual shall sign an2affidavit to that effect before an election inspector and be3allowed to vote as otherwise provided in this act. However, an4elector being allowed to vote without the identification required5under this subsection is subject to challenge as provided in sec-6tion 727.7 (2) If, upon a comparison of the signature or other identi- 8 fication, it is found that the applicant is entitled to vote, the 9 electionofficer havingOFFICIAL IN charge of the registration 10 list shall approve the application,andwrite his or her ini- 11 tials on the application,after whichAND NOTE ON THE 12 APPLICATION the number on the ballot issuedshall be noted on13the applicationTO THE ELECTOR. The application shall serve as 14 1 of the 2 poll lists required to be kept as a record of a person 15 who has voted. The application shall be filed with the township, 16 city, or village clerk. If voter registration cards are used in 17 the precinct, the date of the election shall be noted by 1 of the 18 election officials upon the precinct registration card of each 19 elector voting at an election. If voter registration lists are 20 used in the precinct, the election official shall clearly indi- 21 cate upon the list each elector voting at that election. The 22 clerk of a city, village, or township shall maintain a record of 23 voting participation for each registered elector. 24 Sec. 744. (1) An election inspector oranyotherperson25 INDIVIDUAL in the pollingroom orPLACE, in a compartment con- 26 nected to the pollingroomPLACE, or within 100 feet fromany27 AN entrance to the building in which the polling place is located 04883'01 4 1 shall not persuade or endeavor to persuadea personAN 2 INDIVIDUAL to vote for or againstanyA particular candidate or 3 party ticket, or for or againstanyA ballot question that is 4 being voted on at the election.A personAN INDIVIDUAL shall 5 not place or distribute stickers, other than stickers provided by 6 the election officialspursuant to lawUNDER THIS ACT, in the 7 pollingroomPLACE or in a compartment connected to the polling 8roomPLACE or within 100 feet fromanyAN entrance to the 9 building in which the polling place is located. 10 (2) A person shall not solicit donations, gifts, contribu- 11 tions, purchase of tickets, or similar demands, or request or 12 obtain signatures on petitions in the pollingroom orPLACE, in 13 a compartment connected to the pollingroomPLACE, or within 14 100 feet fromanyAN entrance to the building in which the 15 polling place is located. 16 (3) On election day, a person shall not post, display, or 17 distribute in a polling place, inanyA hallway used by voters 18 to enter or exit a polling place, or within 100 feet of an 19 entrance to a building in which a polling place is locatedany20 material that directly or indirectly makes reference to an elec- 21 tion, a candidate, or a ballot question. This subsection does 22 not apply to official material that is required by law to be 23 posted, displayed, or distributed in a polling place on election 24 day. 25 (4) AN ELECTION INSPECTOR OR OTHER INDIVIDUAL IN THE POLLING 26 PLACE OR WITHIN 100 FEET FROM AN ENTRANCE TO THE BUILDING IN 27 WHICH THE POLLING PLACE IS LOCATED SHALL NOT ASK AN ELECTOR TO 04883'01 5 1 PRODUCE AN OPERATOR'S LICENSE, CHAUFFEUR'S LICENSE, OR OTHER 2 PICTURE IDENTIFICATION CARD AND SHALL NOT ASK AN ELECTOR THE FOL- 3 LOWING QUESTIONS: 4 (A) IF THE ELECTOR OWES BACK CHILD SUPPORT. 5 (B) IF THE ELECTOR HAS AN OUTSTANDING WARRANT FOR HIS OR HER 6 ARREST. 7 (C) IF THE ELECTOR HAS BEEN CONVICTED OF A FELONY. 8 (5)(4)A person who violates this section is guilty of a 9 misdemeanor. 04883'01 Final page.
