        A bill to amend 1979 PA 94, entitled

   "The state school aid act of 1979,"

   by amending section 25b (MCL 388.1625b), as added by 2000

   PA 297.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

           Sec. 25b.  (1) This section applies to a district's enroll-

 2
      ment of a pupil if  all  BOTH of the following apply:

 3
           (a) The pupil transfers from  1 of 3 other districts speci-

 4
      fied by the educating  ANOTHER district and enrolls in the

 5
      EDUCATING district after the pupil membership count day.

 6
           (b) Due to the pupil's enrollment status as of the pupil

 7
      membership count day, the pupil was counted in membership in the

 8
      district from which he or she transfers.

 9
            (c) The total number of pupils enrolled in the district who

10
      are described in subdivisions (a) and (b) and who transfer from 1

      of the 3 other districts specified by the educating district is

 2
      at least equal to the greater of 25 or 1% of the educating

 3
      district's membership.

 4
           (2) If the conditions specified in subsection (1) are met,

 5
      and a pupil transfers from  1 of the 3 other specified districts

 6
      described in subsection (1)(c)  ANOTHER DISTRICT and enrolls

 7
      during a school year in the educating district, the educating

 8
      district shall report the enrollment information to the depart-

 9
      ment and to the district in which the pupil is counted in member-

10
      ship, and the district in which the pupil is counted in member-

11
      ship shall pay to the educating district an amount equal to the

12
      amount of the foundation allowance or per pupil payment as calcu-

13
      lated under section 20 for the district in which the pupil is

14
      counted in membership, prorated according to the number of days

15
      of the school year ending in the fiscal year the pupil is edu-

16
      cated in the educating district compared to the number of days of

17
      the school year ending in the fiscal year the pupil was actually

18
      enrolled in the district in which the pupil is counted in

19
      membership.  The foundation allowance or per pupil payment shall

20
      be adjusted by the pupil's full-time equated status as affected

21
      by the membership definition under section 6(4).  If a district

22
      does not make the payment required under this section within 30

23
      days after receipt of the report, the department shall calculate

24
      the amount owed, shall deduct that amount from the remaining

25
      state school aid payments to the district for that fiscal year

26
      under this act, and shall pay that amount to the educating

27
      district.  The district in which the pupil is counted in

      membership and the educating district shall provide to the

 2
      department all information the department requires to enforce

 3
      this section.

           (3) As used in this section, "educating district" means the

 5
      district in which a pupil enrolls after the pupil membership

 6
      count day as described in subsection (1).
