A bill to amend 1978 PA 368, entitled
"Public health code,"
by amending section 9227 (MCL 333.9227), as amended by 1996 PA
540.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 9227. (1) The SUBJECT TO
SUBSECTION (2), THE depart-
2 ment shall promulgate rules to implement this part, including,
3 but not limited to, rules governing all of the following:
4 (a) Age periods for immunizations.
5 (b) The minimum ages at which immunization may be
6 commenced.
7 (c) The minimum number of doses required during a specified
8 time period.
9 (d) Minimum levels of immunization for children in school.

1 (e) Reporting under section 9206(3).
2 (f) The acquisition, maintenance, and dissemination of
3 information contained in the childhood immunization registry
4 established under section 9207.
5 (2) A PARENT, GUARDIAN, OR PERSON IN LOCO PARENTIS MAY, IN
6 CONSULTATION WITH AN ALLOPATHIC PHYSICIAN OR OSTEOPATHIC PHYSI-
7 CIAN LICENSED UNDER ARTICLE 15, ESTABLISH THE AGES AND DOSES
8 DESCRIBED IN SUBSECTION (1)(A) TO (C). IT MUST BE DONE IN WRIT-
9 ING, AND THE WRITING MUST BE PRESENTED TO THE HEALTH CARE PRO-
10 VIDER AT THE TIME AN IMMUNIZING AGENT IS ADMINISTERED TO THE
11 PARENT'S, GUARDIAN'S, OR PERSON IN LOCO PARENTIS'S CHILD. THE
12 HEALTH CARE PROVIDER ADMINISTERING THE IMMUNIZING AGENT SHALL
13 MAKE AN ENTRY OF THE IMMUNIZATION ON THE CHILD'S CERTIFICATE OF
14 IMMUNIZATION IN THE MANNER PRESCRIBED BY SECTION 9206(1).
