A bill to establish the Amanda's fund for breast cancer

research in the department of community health; to provide for

the distribution of money from the fund; to prescribe the duties

and powers of certain agencies and officials; and to provide for

appropriations.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1 Sec. 1. This act shall be known and may be cited as the

2 "Amanda's fund for cancer research act".

3 Sec. 2. As used in this act:

4 (a) "Department" means the department of community health.

5 (b) "Fund" means the Amanda's fund for breast cancer

6 research created in section 3.

7 Sec. 3. (1) The Amanda's fund for breast cancer research is

8 created in the department to provide funds to promote research in

9 this state relating to breast cancer.

1 (2) The state treasurer shall credit to the fund all amounts

2 appropriated for this purpose under section 438 of the income tax

3 act of 1967, 1967 PA 281, MCL 206.438.

4 (3) The fund shall consist of the money credited to the fund

5 pursuant to section 438 of the income tax act of 1967, 1967 PA

6 281, MCL 206.438, any interest and earnings accruing from the

7 saving and investment of that money, and other appropriations,

8 money, or other things of value received by the fund.

9 (4) The state treasurer shall direct the investment of the

10 fund.

11 (5) Money in the fund at the close of the year shall remain

12 in the fund and shall not lapse to the general fund.

13 Sec. 4. (1) The money, interest, and earnings of the fund

14 shall be expended solely for the purposes described in this act.

15 (2) Money granted or received as a gift or donation to the

16 fund is available for distribution upon appropriation.

17 Sec. 5. The department shall do all of the following with

18 the money from the fund:

19 (a) Support the development of a statewide breast cancer

20 research plan.

21 (b) Provide information to the public about the value of

22 breast cancer research and early detection.

23 (c) Develop and publicize criteria for proposals to be

24 funded under this act.

25 (d) Review and approve proposals to be funded under this

26 act.

1 Sec. 6. (1) The department shall determine which proposals

2 to fund with money from the fund. The department shall solicit

3 proposals and approve proposals for funding under this act.

4 Proposals may be submitted only by individuals, groups, and

5 institutions with an interest in breast cancer research

6 activities.

7 (2) The department shall review and approve proposals sub-

8 mitted for funding under this act and shall give priority to pro-

9 posals submitted by applicants that are located in this state and

10 that conduct the research or other activity that is the basis for

11 the proposal in this state. The money in the fund shall be used

12 to fund, but is not limited to funding, the following types of

13 programs:

14 (a) Proposals for applied breast cancer research.

15 (b) Community education programs to raise awareness through

16 county, city, or township programs.

17 Sec. 7. Money from the fund may be used as matching funds

18 for a federal grant or a grant from the national cancer

19 institute.

20 Sec. 8. The money in the fund that is available for distri-

21 bution shall be appropriated each year.

22 Enacting section 1. This act does not take effect unless

23 Senate Bill No. 1353

24 of the 91st Legislature is enacted into law.
