SUMMARY OF SENATE BILL 145 AS PASSED BY THE SENATE
Public Act 296 of 1969 currently provides a process for the transfer of road jurisdiction from a county road commission to a city or village. Senate Bill 145 would amend PA 296 to provide a process by which a county road commission could initiate the transfer of a road, previously under the road commission's jurisdiction, from a city or village back to the jurisdiction of the county road commission. The bill would require the county road commission make specific findings regarding the road before the transfer could take place.
FISCAL IMPACT:
When road jurisdiction is transferred from one unit of government to another, liability for the road, including related maintenance costs, would be transferred as well. The road commission taking back jurisdiction would receive additional Michigan Transportation Fund (MTF) revenue, and the city or village giving up jurisdiction would receive less MTF revenue, in accordance with the MTF distribution formula of PA 51 of 1951, which is based in part on road/street miles. These fiscal impacts would affect only the two local units of government involved in the jurisdictional transfer. There would be no fiscal impact to the state or to other local units of government.
