ADDENDUM TO SENATE FISCAL AGENCY ANALYSIS OF SB 293 DATED 4-1-03:
HOUSE COMMITTEE ACTION:
The members of the House Committee on Local Government and Urban policy adopted one substantive amendment to the Senate-passed version of the bill. That amendment gives the director of the Department of State Police the authority to reverse an earlier decision that enabled local government public safety agencies to attach their equipment to state radio towers.
The amendment specifies that the director could rescind the permission to install or attach equipment to a tower if that equipment impeded funded upgrades to the Michigan public safety communications system. However, under the amendment, the determination about impediments would be limited only to structural, wind load, and radio frequency analyses, and the cost of these analyses would be borne by the Department of State Police.
Finally, if the analyses indicated that the local government public safety equipment required removal or relocation, then the department would notify the local public safety agency in writing and provide a copy of the analyses. Under the amendment, the department would be required to allow the local agency sufficient time-although not more than one year-to remove or relocate the equipment.
