A SUMMARY OF HOUSE BILL 4102 AS INTRODUCED 1-29-03

The bill would add a new section to the Corrections Code to require a prisoner, prior to release on parole or discharge without parole, to be tested for HIV or an antibody to HIV. The test would have to be given not earlier than 60 days before the prisoner was paroled or discharged. The Department of Corrections would have to report each positive test result to the Department of Community Health in compliance with Section 5114 of the Public Health Code. As used in the bill, "HIV" and "positive test result" mean those terms as defined in Section 67 of the Corrections Code.
