SUBSTITUTE FOR
HOUSE BILL NO. 4463
A bill to amend 1949 PA 300, entitled
"Michigan vehicle code,"
(MCL 257.1 to 257.923) by adding section 811q.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 811q. (1) The secretary of state shall develop and,
2 upon application, may issue a fund-raising plate and a matching
3 collector plate promoting cancer awareness. The plate shall
4 include the pink ribbon emblem of the Susan G. Komen breast
5 cancer foundation and be of a design as determined by the
6 secretary of state.
7 (2) Fund-raising donations for plates promoting cancer
8 awareness collected under sections 811f and 811g shall be
9 disbursed under section 811h by the secretary of state to the
10 state treasurer, who shall credit the donation money to the
11 cancer awareness fund created under subsection (3).

1 (3) The cancer awareness fund is created within the state
2 treasury. The state treasurer may receive money or other assets
3 from any source for deposit into the fund. The state treasurer
4 shall direct the investment of the fund. The state treasurer
5 shall credit to the fund interest and earnings from fund
6 investments. Money in the fund at the close of the fiscal year
7 shall remain in the fund and shall not lapse to the general
8 fund. The state treasurer shall disburse the money in the fund
9 on a quarterly basis in the following manner:
10 (a) One-third to the Michigan chapter of the American cancer
11 society.
12 (b) One-third to the Barbara Ann Karmanos cancer institute.
13 (c) One-third to the Michigan hospice and palliative care
14 organization.
[(4) Each recipient of funds listed in subsection (3) shall annually report to the department of treasury an accounting of money received and used under subsection (3).]
15 Enacting section 1. This amendatory act takes effect
16 January 1, 2004.
17 Enacting section 2. This amendatory act does not take
18 effect unless Senate Bill No. 785 of the 92nd Legislature is
19 enacted into law.
