SUBSTITUTE FOR
HOUSE BILL NO. 5368
A bill to amend 1971 PA 174, entitled
"Office of child support act,"
(MCL 400.231 to 400.240) by adding section 12.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 12. (1) By December 1 of each year, the office shall
2 submit to the attorney general a list of names of payers who meet
3 the requirements of this subsection. The list shall include the
4 amount owed by each payer and indicate whether the location of
5 each payer is known, unknown, or unverified. A payer shall be
6 included on the list of names of payers submitted to the attorney
7 general if, on the date the list was compiled, all of the
8 following apply to the payer:
9 (a) The payer owes more than $200,000.00 in past due child
10 support.
11 (b) The payer's case receives services under title IV-D.
1 (c) The past due child support was not paid within 30 days
2 after the mailing of the notice required under subsection (3).
3 (d) The payer has not, since the mailing of the notice under
4 subsection (3), entered into a written agreement with the friend
5 of the court for payment of the past due child support.
6 (e) The payer did not make timely child support payments for
7 12 consecutive months immediately before the list of payers was
8 compiled.
9 (f) The payer has not filed a petition for bankruptcy and a
10 stay of the order to pay child support has not been entered by
11 the family division of circuit court.
12 (g) The payer does not receive public assistance.
13 (h) The recipient of support consents to disclosure of the
14 payer's information.
15 (2) The office of the attorney general may do all of the
16 following utilizing the list of payers under subsection (1):
17 (a) Publish and update, on an appropriate internet website, a
18 list of payers.
19 (b) Distribute a "most wanted" list that includes names and
20 photographs, if available, of payers under this section. The
21 "most wanted" list may be posted on the internet and in public
22 places.
23 (3) Thirty days before the submission to the attorney general
24 under subsection (1) of a payer's information, the office shall
25 send by ordinary mail to the last known address of each
26 applicable payer and recipient of support a notice of possible
27 disclosure. The notice shall detail the amount of past due child
1 support and the office of attorney general's intent to disclose
2 the payer's name, photograph, and amount of past due child
3 support.
