A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding section 80134a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 80134a. (1) The operator of a vessel who knows or who
2 has reason to believe that he or she has been involved in an
3 accident resulting in serious impairment of a body function or
4 death of a person shall immediately stop his or her vessel at the
5 scene of the accident and shall remain there until the
6 requirements of sections 80133 and 80134 are fulfilled.
7 (2) Except as provided in subsection (3), a person who
8 violates subsection (1) is guilty of a felony punishable by
9 imprisonment for not more than 5 years or by a fine of not more
10 than $5,000.00, or both.
11 (3) A person who violates subsection (1) following an

1 accident caused by that person that results in the death of
2 another person is guilty of a felony punishable by imprisonment
3 for not more than 15 years or a fine of not more than $10,000.00,
4 or both.
<<(4) As used in this section, "serious impairment of a body function" means that term as defined in section 58c of the Michigan vehicle code, 1949 PA 300, MCL 257.58c.
Enacting section 1. This amendatory act takes effect [April 1], 2004.>>
