HOUSE SUBSTITUTE FOR
SENATE BILL NO. 785
A bill to amend 1949 PA 300, entitled
"Michigan vehicle code,"
by amending sections 217d, 801, 811d, 811e, 811f, 811g, 811h,
811i, 811j, 811k, 811l, and 811n (MCL 257.217d, 257.801,
257.811d, 257.811e, 257.811f, 257.811g, 257.811h, 257.811i,
257.811j, 257.811k, 257.811l, and 257.811n), sections 217d, 801,
and 811h as amended by 2003 PA 152, sections 811d, 811f, and 811g
as added by 2000 PA 77, section 811e as amended by 2001 PA 124,
section 811i as added by 2000 PA 74, section 811j as added by
2000 PA 71, section 811k as added by 2000 PA 73, section 811l as
added by 2000 PA 70, and section 811n as added by 2000 PA 79, and
by adding sections 811m, 811o, and 811p; and to repeal acts and
parts of acts.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 217d. (1) The secretary of state shall design and may
1 issue a special congressional medal of honor registration plate
2 for residents of this state awarded the congressional medal of
3 honor.
4 (2) A special congressional medal of honor registration plate
5 shall be issued only for 1 vehicle intended for personal use by
6 the applicant.
7 (3) A person who is a recipient of the congressional medal of
8 honor may apply to the secretary of state for a special
9 registration plate under this section on a form prescribed by the
10 secretary of state, which shall be accompanied by any proof of
11 the applicant having been a congressional medal of honor
12 recipient that the secretary of state may require. The secretary
13 of state shall waive the $5.00 service fee requirement under
14 section 804.
15 (4) A person who qualifies to be issued a special
16 registration plate under this section is entitled to only 1
17 special registration plate issued under subsection (1) that is
18 exempt from payment of the tax provided in section 801.
19 (5) A person with disabilities who applies for a special
20 registration plate under this section shall be issued a tab for
21 persons with disabilities as provided in section 803f for his or
22 her special registration plate. The secretary of state shall
23 require the same proof that the applicant is disabled as is
24 required for issuance of a permanent windshield placard under
25 section 675.
26 (6) A special registration plate issued under subsection (1)
27 expires on the birthday of the vehicle owner in a year in which
1 new plates are issued by the secretary of state.
2 (7) The secretary of state shall deliver or cause to be
3 delivered 1 or more special registration plates issued under this
4 section to the home address of the applicant at no additional
5 cost to the applicant.
6 (8) The secretary
of state shall develop and, upon
7 application, may issue
a Michigan veterans memorial registration
8 plate to an applicant
for use on the passenger motor vehicle,
9 pickup truck, van,
motor home, hearse, bus, trailer coach, or
10 trailer for which the
registration plate is issued instead of a
11 standard registration
plate. Michigan veterans memorial
12 registration plates
shall bear letters and numbers that the
13 secretary of state
prescribes. The plate shall be of a design as
14 determined by the
secretary of state. The word "Michigan" shall
15 appear on each
Michigan veterans memorial registration plate.
16 (9) An application
for a Michigan veterans memorial
17 registration plate
shall be submitted to the secretary of state
18 pursuant to the
procedures prescribed in section 217.
19 Application for an
original or renewal Michigan veterans memorial
20 registration plate
shall be accompanied with payment of the
21 regular vehicle
registration tax in addition to the following:
22 (a) For an original
Michigan veterans memorial registration
23 plate, a donation of
$25.00 and a service fee of not more than
24 $10.00, as determined
by the secretary of state.
25 (b) For a renewal
Michigan veterans memorial registration
26 plate, a service fee
of $10.00.
27 (10) A Michigan
veterans memorial registration plate shall
1 expire as described in
section 226. Upon the issuance or renewal
2 of a Michigan veterans
memorial registration plate, the secretary
3 of state may issue a
tab or tabs designating the month and year
4 of expiration.
5 (11) The secretary
of state may issue a temporary
6 registration permit to
a person who submits an application and
7 the proper payments
for a Michigan veterans memorial registration
8 plate if the
applicant's current vehicle registration will expire
9 before his or her
receipt of a Michigan veterans memorial
10 registration plate.
The temporary registration shall expire upon
11 receipt of a Michigan
veterans memorial registration plate or 60
12 days after the
issuance of a Michigan veterans memorial
13 registration plate,
whichever occurs first. The temporary permit
14 shall be issued without
a separate fee.
15 (12) Michigan
veterans memorial registration plate service
16 fees collected under
this section by the secretary of state shall
17 be identified and
segregated by the secretary of state into a
18 separate account.
After deducting the manufacturing and
19 administrative costs
of the secretary of state, including
20 administrative costs
associated with issuing, replacing, and
21 substituting plates,
the secretary of state shall on a quarterly
22 basis transfer all of
the donations and the balance of the
23 Michigan veterans
memorial registration plate service fees to the
24 state treasurer who
shall credit the fee money to the Vietnam
25 veterans memorial monument
fund created in section 3 of the
26 Michigan Vietnam
veterans memorial act, 1988 PA 234, MCL
27 35.1053. These funds
shall be used exclusively for the purposes
1 described in sections
5 and 7 of the Michigan Vietnam veterans
2 memorial act, 1988 PA
234, MCL 35.1055 and 35.1057.
3 (13) For purposes
of this section, "Michigan veterans
4 memorial registration
plate" means a registration plate
5 containing a
specialized design pertaining to Michigan veterans.
6 Sec. 801. (1) The secretary of state shall collect the
7 following taxes at the time of registering a vehicle, which shall
8 exempt the vehicle from all other state and local taxation,
9 except the fees and taxes provided by law to be paid by certain
10 carriers operating motor vehicles and trailers under the motor
11 carrier act, 1933 PA 254, MCL 475.1 to 479.43; the taxes imposed
12 by the motor carrier fuel tax act, 1980 PA 119, MCL 207.211 to
13 207.234; and except as otherwise provided by this act:
14 (a) For a motor vehicle, including a motor home, except as
15 otherwise provided, and a pickup truck or van that weighs not
16 more than 5,000 pounds, except as otherwise provided, according
17 to the following schedule of empty weights:

9 On October 1, 1983, and October 1, 1984, the tax assessed
10 under this subdivision shall be annually revised for the
11 registrations expiring on the appropriate October 1 or after that
12 date by multiplying the tax assessed in the preceding fiscal year
13 times the personal income of Michigan for the preceding calendar
14 year divided by the personal income of Michigan for the calendar
15 year which preceded that calendar year. In performing the
16 calculations under this subdivision, the secretary of state shall
17 use the spring preliminary report of the United States department
18 of commerce or its successor agency. A van which is owned by an
19 individual who uses a wheelchair or by an individual who
20 transports a resident of his or her household who uses a
21 wheelchair and for which registration plates are issued pursuant
22 to section 803d shall be assessed at the rate of 50% of the tax
23 provided for in this subdivision.
24 (b) For a trailer coach attached to a motor vehicle, the tax
25 shall be assessed as provided in subdivision (l). A trailer
26 coach not under 1959 PA 243, MCL 125.1035 to 125.1043, and while
27 located on land otherwise assessable as real property under the
1 general property tax act, 1893 PA 206, MCL 211.1 to 211.157, if
2 the trailer coach is used as a place of habitation, and whether
3 or not permanently affixed to the soil, shall not be exempt from
4 real property taxes.
5 (c) For a road tractor, truck, or truck tractor owned by a
6 farmer and used exclusively in connection with a farming
7 operation, including a farmer hauling livestock or farm equipment
8 for other farmers for remuneration in kind or in labor, but not
9 for money, or used for the transportation of the farmer and the
10 farmer's family, and not used for hire, 74 cents per 100 pounds
11 of empty weight of the road tractor, truck, or truck tractor. If
12 the road tractor, truck, or truck tractor owned by a farmer is
13 also used for a nonfarming operation, the farmer shall be subject
14 to the highest registration tax applicable to the nonfarm use of
15 the vehicle but shall not be subject to more than 1 tax rate
16 under this act.
17 (d) For a road tractor, truck, or truck tractor owned by a
18 wood harvester and used exclusively in connection with the wood
19 harvesting operations or a truck used exclusively to haul milk
20 from the farm to the first point of delivery, 74 cents per 100
21 pounds of empty weight of the road tractor, truck, or truck
22 tractor. A registration secured by payment of the fee as
23 prescribed in this subdivision shall continue in full force and
24 effect until the regular expiration date of the registration. As
25 used in this subdivision, "wood harvester" includes the person or
26 persons hauling and transporting raw materials in the form
27 produced at the harvest site. As used in this subdivision, "wood
1 harvesting operations" does not include the transportation of
2 processed lumber, Christmas trees, or processed firewood for a
3 profit making venture.
4 (e) For a hearse or ambulance used exclusively by a licensed
5 funeral director in the general conduct of the licensee's funeral
6 business, including a hearse or ambulance whose owner is engaged
7 in the business of leasing or renting the hearse or ambulance to
8 others, $1.17 per 100 pounds of the empty weight of the hearse or
9 ambulance.
10 (f) For a vehicle owned and operated by this state, a state
11 institution, a municipality, a privately incorporated, nonprofit
12 volunteer fire department, or a nonpublic, nonprofit college or
13 university, $5.00 per plate. A registration plate issued under
14 this subdivision shall expire on June 30 of the year in which new
15 registration plates are reissued for all vehicles by the
16 secretary of state.
17 (g) For a bus including a station wagon, carryall, or
18 similarly constructed vehicle owned and operated by a nonprofit
19 parents' transportation corporation used for school purposes,
20 parochial school or society, church Sunday school, or any other
21 grammar school, or by a nonprofit youth organization or nonprofit
22 rehabilitation facility; or a motor vehicle owned and operated by
23 a senior citizen center,
$10.00 per set plate, if the bus,
24 station wagon, carryall, or similarly constructed vehicle or
25 motor vehicle is designated by proper signs showing the
26 organization operating the vehicle.
27 (h) For a vehicle owned by a nonprofit organization and used
1 to transport equipment for providing dialysis treatment to
2 children at camp; for a vehicle owned by the civil air patrol, as
3 organized under sections
40301 to 40307 of title 36 of the
4 United States Code, 36
U.S.C. 36 USC 40301 to 40307,
$10.00 per
5 plate, if the vehicle is designated by a proper sign showing the
6 civil air patrol's name; for a vehicle owned and operated by a
7 nonprofit veterans center; for a vehicle owned and operated by a
8 nonprofit recycling center or a federally recognized nonprofit
9 conservation organization; for a motor vehicle having a truck
10 chassis and a locomotive
or ship's body which that is owned by
11 a nonprofit veterans organization and used exclusively in parades
12 and civic events; or for an emergency support vehicle used
13 exclusively for emergencies and owned and operated by a federally
14 recognized nonprofit charitable organization, $10.00 per plate.
15 (i) For each truck owned and operated free of charge by a
16 bona fide ecclesiastical or charitable corporation, or red cross,
17 girl scout, or boy scout organization, 65 cents per 100 pounds of
18 the empty weight of the truck.
19 (j) For each truck ,
weighing 8,000 pounds or less , and
20 not used to tow a vehicle, for each privately owned truck used to
21 tow a trailer for recreational purposes only and not involved in
22 a profit making venture, and for each vehicle designed and used
23 to tow a mobile home or a trailer coach, except as provided in
24 subdivision (b), $38.00 or an amount computed according to the
25 following schedule of empty weights, whichever is greater:

7 If the tax required under subdivision (p) for a vehicle of

11 subdivision for an identical vehicle, the tax required under this
12 subdivision shall not be less than the tax required under
13 subdivision (p) for a vehicle of the same model year with the
14 same list price.
15 (k) For each truck weighing 8,000 pounds or less towing a
16 trailer or any other combination of vehicles and for each truck
17 weighing 8,001 pounds or more, road tractor or truck tractor,
18 except as provided in subdivision (j) according to the following
19 schedule of elected gross weights:

13 For each commercial vehicle registered pursuant to this
14 subdivision, $15.00 shall be deposited in a truck safety fund to
15 be expended for the purposes prescribed in section 25 of 1951
16 PA 51, MCL 247.675.
17 If a truck or road tractor without trailer is leased from an
18 individual owner-operator, the lessee, whether a person, firm, or
19 corporation, shall pay to the owner-operator 60% of the fee
20 prescribed in this subdivision for the truck tractor or road
21 tractor at the rate of 1/12 for each month of the lease or
22 arrangement in addition to the compensation the owner-operator is
23 entitled to for the rental of his or her equipment.
24 (l) For each pole trailer, semitrailer, trailer coach, or
25 trailer, the tax shall be assessed according to the following
26 schedule of empty weights:

4 The registration plate issued under this subdivision expires
5 only when the secretary of state reissues a new registration
6 plate for all trailers. If
Beginning October 1, 2003, if the
7 secretary of state reissues a new registration plate for all
8 trailers, a person who
has once paid the fee tax as increased
9 by 2003 PA 152 for a vehicle under this subdivision shall not be
10 required to pay the fee
tax for that vehicle a second time, but
11 shall be required to pay only the cost of the reissued plate at
12 the rate provided in section 804(2) for a standard plate. A
13 registration plate issued under this subdivision is
14 nontransferable.
15 (m) For each commercial vehicle used for the transportation
16 of passengers for hire except for a vehicle for which a payment
17 is made pursuant to 1960 PA 2, MCL 257.971 to 257.972, according
18 to the following schedule of empty weights:

25 On October 1, 1983, and October 1, 1984, the tax assessed
26 under this subdivision shall be annually revised for the
27 registrations expiring on the appropriate October 1 or after that
1 date by multiplying the tax assessed in the preceding fiscal year
2 times the personal income of Michigan for the preceding calendar
3 year divided by the personal income of Michigan for the calendar
4 year which preceded that calendar year. In performing the
5 calculations under this subdivision, the secretary of state shall
6 use the spring preliminary report of the United States department
7 of commerce or its successor agency.
8 Beginning January 1, 1984, the registration tax for each
9 motorcycle shall be increased by $3.00. The $3.00 increase shall
10 not be considered as part of the tax assessed under this
11 subdivision for the purpose of the annual October 1 revisions but
12 shall be in addition to the tax assessed as a result of the
13 annual October 1 revisions. Beginning January 1, 1984, $3.00 of
14 each motorcycle fee shall be placed in a motorcycle safety fund
15 in the state treasury and shall be used only for funding the
16 motorcycle safety education program as provided for under
17 sections 312b and 811a.
18 (o) For each truck weighing 8,001 pounds or more, road
19 tractor, or truck tractor used exclusively as a moving van or
20 part of a moving van in transporting household furniture and
21 household effects or the equipment or those engaged in conducting
22 carnivals, at the rate of 80% of the schedule of elected gross
23 weights in subdivision (k) as modified by the operation of that
24 subdivision.
25 (p) After September 30, 1983, each motor vehicle of the 1984
26 or a subsequent model year as shown on the application required
27 under section 217 which
that has not been previously subject to
1 the tax rates of this
section and which that is of the motor
2 vehicle category otherwise subject to the tax schedule described
3 in subdivision (a), and each low-speed vehicle according to the
4 following schedule based upon registration periods of 12 months:
5 (i) Except as otherwise provided in this subdivision, for the
6 first registration ,
which that is not a transfer registration
7 under section 809, and for the first registration after a
8 transfer registration under section 809, according to the
9 following schedule based on the vehicle's list price:

10 by $5.00 for each $1,000.00 increment or fraction of a $1,000.00
11 increment over $30,000.00. If a current fee increases or
12 decreases as a result of 1998 PA 384, only a vehicle purchased or
13 transferred after January 1, 1999 shall be assessed the increased
14 or decreased fee.
15 (ii) For the second registration, 90% of the tax assessed
16 under subparagraph (i).
17 (iii) For the third registration, 90% of the tax assessed
18 under subparagraph (ii).
19 (iv) For the fourth and subsequent registrations, 90% of the
20 tax assessed under subparagraph (iii).
21 For a vehicle of the 1984 or a subsequent model year that has
22 been previously registered by a person other than the person
23 applying for registration or for a vehicle of the 1984 or a
24 subsequent model year that has been previously registered in
25 another state or country and is registered for the first time in
26 this state, the tax under this subdivision shall be determined by
27 subtracting the model year of the vehicle from the calendar year
1 for which the registration is sought. If the result is zero or a
2 negative figure, the first registration tax shall be paid. If
3 the result is 1, 2, or 3 or more, then, respectively, the second,
4 third, or subsequent registration tax shall be paid. A van
5 which that is owned by an individual who uses a
wheelchair or
6 by an individual who transports a resident of his or her
7 household who uses a wheelchair and for which registration plates
8 are issued pursuant to section 803d shall be assessed at the rate
9 of 50% of the tax provided for in this subdivision.
10 (q) For a wrecker, $200.00.
11 (r) When the secretary of state computes a tax under this
12 section, a computation that does not result in a whole dollar
13 figure shall be rounded to the next lower whole dollar when the
14 computation results in a figure ending in 50 cents or less and
15 shall be rounded to the next higher whole dollar when the
16 computation results in a figure ending in 51 cents or more,
17 unless specific fees are specified, and the secretary of state
18 may accept the manufacturer's shipping weight of the vehicle
19 fully equipped for the use for which the registration application
20 is made. If the weight is not correctly stated or is not
21 satisfactory, the secretary of state shall determine the actual
22 weight. Each application for registration of a vehicle under
23 subdivisions (j) and (m) shall have attached to the application a
24 scale weight receipt of the vehicle fully equipped as of the time
25 the application is made. The scale weight receipt is not
26 necessary if there is presented with the application a
27 registration receipt of
the previous year which that shows on
1 its face the weight of the motor vehicle as registered with the
2 secretary of state and which
that is accompanied by a statement
3 of the applicant that there has not been a structural change in
4 the motor vehicle which
that has increased the weight and that
5 the previous registered weight is the true weight.
6 (2) A manufacturer is not exempted under this act from paying
7 ad valorem taxes on vehicles in stock or bond, except on the
8 specified number of motor vehicles registered. A dealer is
9 exempt from paying ad valorem taxes on vehicles in stock or
10 bond.
11 (3) Until October 1, 2009, the fee for a vehicle with an
12 empty weight over 10,000 pounds imposed pursuant to subsection
13 (1)(a) and the fees
imposed pursuant to subsection (1)(b), (c)
14 (1)(c), (d), (e), (f), (i), (j), (m), (o), and (p) shall each be
15 increased as follows:
16 (a) A regulatory fee of $2.25, which shall be credited to the
17 traffic law enforcement and safety fund created in section 819a
18 and used for the purpose of regulating highway safety.
19 (b) A fee of $5.75, which shall be credited to the
20 transportation administration collection fund created in section
21 810b.
22 (4) If a tax required to be paid under this section is not
23 received by the secretary of state on or before the expiration
24 date of the registration plate, the secretary of state shall
25 collect a late fee of $10.00 for each registration renewed after
26 the expiration date. An application for a renewal of a
27 registration using the regular mail and postmarked before the
1 expiration date of that registration shall not be assessed a late
2 fee. The late fee collected under this subsection shall be
3 deposited into the general fund.
4 (5) As used in this section:
5 (a) "Gross proceeds" means gross proceeds as defined in
6 section 1 of the general sales tax act, 1933 PA 167, MCL 205.51.
7 However, gross proceeds shall include the value of the motor
8 vehicle used as part payment of the purchase price as that value
9 is agreed to by the parties to the sale, as evidenced by the
10 signed agreement executed pursuant to section 251.
11 (b) "List price" means the manufacturer's suggested base list
12 price as published by the secretary of state, or the
13 manufacturer's suggested retail price as shown on the label
14 required to be affixed to the vehicle under section 3 of the
15 automobile information
disclosure act, Public Law 85-506,
16 15 U.S.C. 15 USC 1232, if the secretary of state has not
at the
17 time of the sale of the vehicle published a manufacturer's
18 suggested retail price for that vehicle, or the purchase price of
19 the vehicle if the manufacturer's suggested base list price is
20 unavailable from the sources described in this subdivision.
21 (c) "Purchase price" means the gross proceeds received by the
22 seller in consideration of the sale of the motor vehicle being
23 registered.
24 Sec. 811d. (1) As used in this chapter:
25 (a) "Fund-raising plate" means a registration plate
26 authorized to raise funds for a specified goal.
27 (b) "Collector plate" means a collector plate that matches
1 any registration plate developed and issued under this act.
2 (c) "Nonprofit" means that which is exempt from taxation
3 under section 501(c)(3) of the internal revenue code, 26 USC 501.
4 (d) "Transportation administration collection fund" means the
5 fund created under section 810b.
6 (2) A fund-raising registration
plate series shall
7 contain all of the following as prescribed or approved by the
8 secretary of state:
9 (a) The same generic background.
10 (b) Letters and numbers, except a personalized fund-raising
11 registration plate shall contain not more than 5 letter or number
12 characters.
13 (c) The word "Michigan" and any other unique identifier
14 specified by the secretary of state.
15 (d) A design or logo.
16 (3) If the design or logo of a fund-raising plate uses 1 or
17 more designs, trade names, trademarks, service marks, emblems,
18 symbols, or other images that are owned by a Michigan university
19 or other person, the Michigan university or other person shall
20 grant to or obtain for the secretary of state both of the
21 following pursuant to a written agreement between the parties:
22 (a) A nonexclusive worldwide license to use those designs,
23 trade names, trademarks, service marks, emblems, symbols, or
24 other images on and in conjunction with the marketing, promotion,
25 sale, or copyrighting of the registration plate or image of the
26 fund-raising plate.
27 (b) The authority to merchandise the fund-raising plate or an
1 image of the fund-raising plate.
2 (4) In using or employing a design, trade name, trademark,
3 service mark, emblem, symbol, logo, or other image on and in
4 conjunction with the marketing, promotion, sale, copyrighting, or
5 merchandising of a fund-raising plate or image of the
6 fund-raising plate, the secretary of state may alter the size of
7 the design, trade name, trademark, service mark, emblem, symbol,
8 logo, or other image but shall not change the color or design of
9 the design, trade name, trademark, service mark, emblem, symbol,
10 logo, or other image without the prior written consent of the
11 respective Michigan university or other person. The secretary of
12 state shall not use or employ a design, trade name, trademark,
13 service mark, emblem, symbol, logo, or other image on and in
14 conjunction with the marketing, promotion, sale, copyrighting, or
15 merchandising of a fund-raising plate or an image of the
16 fund-raising plate in any manner that is offensive to the
17 Michigan university or other person that owns the design, trade
18 name, trademark, service mark, emblem, symbol, logo, or other
19 image that is the subject of a written agreement under subsection
20 (3).
21 Sec. 811e. (1) The
Beginning May 1, 2004, the secretary
22 of state may develop a Michigan
university fund-raising
23 registration plate as
described in this section, and a matching
24 Michigan university
collector plate as described in section 811g
25 fund-raising plate as provided in this section.
26 (2) A start-up fee of $15,000.00 shall be paid for any new
27 fund-raising plate authorized under this section, which fee shall
1 be deposited in the transportation administration collection fund
2 to be used for the cost of creating, producing, and issuing
3 fund-raising plates. If the fee described in this subsection is
4 not paid within 18 months of the effective date of the public act
5 that authorizes the development and issuance of a fund-raising
6 plate, then the related fund-raising plate shall not be created,
7 produced, or issued. A start-up fee paid under this subsection
8 is nonrefundable.
9 (3) Not less than 3 years after the secretary of state first
10 issues 1 of the fund-raising plates as described in subsection
11 (1) and upon payment of $2,000.00, the Michigan university or
12 other person sponsoring that fund-raising plate may redesign it
13 as approved by the secretary of state. The payment required
14 under this subsection shall be deposited in the transportation
15 administration collection fund to be used for the cost of
16 creating, producing, and issuing fund-raising plates. A payment
17 under this subsection is nonrefundable.
18 (4) (2) The
secretary of state may develop 1 or more
19 limited term registration
plates to recognize a state-sponsored
20 event, a Michigan university , or an accomplishment
or
21 occasion of a Michigan university.
22 (3) The secretary
of state may, at any 1 time, develop not
23 more than 7 different
state-sponsored fund-raising registration
24 plates as described in
this section, and matching state-sponsored
25 collector plates as
described in section 811g. As used in this
26 section,
"state-sponsored fund-raising registration plate" means
27 a fund-raising
registration plate authorized by a public act to
1 raise funds for a
state-sponsored goal. The public act shall, at
2 a minimum, do all of
the following:
3 (5) The secretary of state shall not develop or issue a
4 fund-raising plate unless a public act authorizing the
5 fund-raising plate, at a minimum, does all of the following:
6 (a) Identify Identifies
the purpose of the state-sponsored
7 fund-raising
registration fund-raising
plate.
8 (b) Create Creates
a fund or designate an existing
9 nonprofit fund or designates an existing nonprofit fund to
10 receive the money raised
through the sale of state-sponsored
11 fund-raising
registration fund-raising
plates and matching
12 collector plates.
13 (c) If a fund is
created, name names the person or entity
14 responsible for administering the fund.
15 (4) The secretary
of state may develop, promote, and market
16 the fund-raising
registration plates and matching collector
17 plates issued under
this section with the funds available through
18 service fees.
19 (5) If the design
or logo of a Michigan university
20 fund-raising
registration plate or a state-sponsored fund-raising
21 registration plate
uses 1 or more designs, trade names,
22 trademarks, service
marks, emblems, symbols, or other images that
23 are owned by the
Michigan university that is requesting the
24 Michigan university
fund-raising plate, the person or entity that
25 is sponsoring a
state-sponsored fund-raising plate, or any other
26 person or entity, the
Michigan university or sponsoring person or
27 entity shall grant to
or obtain for the secretary of state both
1 of the following
pursuant to a written agreement between the
2 parties:
3 (a) A nonexclusive
worldwide license to use those designs,
4 trade names,
trademarks, service marks, emblems, symbols, or
5 other images on and in
conjunction with the marketing, promotion,
6 sale, or copyrighting
of the registration plate or image of the
7 registration plate.
8 (b) The authority
to merchandise the registration plate or an
9 image of the
registration plate.
10 (6) In using or
employing a design, trade name, trademark,
11 service mark, emblem,
symbol, logo, or other image on and in
12 conjunction with the
marketing, promotion, sale, copyrighting, or
13 merchandising of a
registration plate or image of the
14 registration plate,
the secretary of state may alter the size of
15 the design, trade
name, trademark, service mark, emblem, symbol,
16 logo, or other image
but shall not change the color or design of
17 the design, trade
name, trademark, service mark, emblem, symbol,
18 logo, or other image
without the prior written consent of the
19 respective Michigan
university or sponsoring person or entity.
20 The secretary of state
shall not use or employ a design, trade
21 name, trademark,
service mark, emblem, symbol, logo, or other
22 image on and in
conjunction with the marketing, promotion, sale,
23 copyrighting, or
merchandising of a registration plate or an
24 image of the registration
plate in any manner that is offensive
25 to the Michigan
university or sponsoring person or entity that
26 complies with
subsection (5).
27 (7) As used in
this section, "Michigan university
1 fund-raising
registration plate" means a fund-raising
2 registration plate
that is issued under this section at the
3 request of a Michigan
university.
4 Sec. 811f. (1) The secretary of state may, upon
5 application, issue 1
fund-raising registration plate instead of
6 a standard registration plate to a person for use on a passenger
7 motor vehicle or motor home or a pickup truck or van used
8 exclusively to transport personal possessions or family members
9 for nonbusiness purposes.
10 (2) A person who
wants to purchase a Michigan university or
11 state-sponsored may be issued a fund-raising registration
12 plate for use on a
vehicle under this act shall apply by
13 applying to the secretary
of state for a fund-raising
14 registration plate pursuant to the procedures prescribed in
15 section 217. An application for an original fund-raising
16 registration plate shall be accompanied by a $25.00
17 fund-raising donation, payment of the regular vehicle
18 registration tax provided
for prescribed under this act, and a
19 $10.00 service fee. An application for renewal of a fund-raising
20 registration plate shall be accompanied by payment of the
21 regular vehicle registration tax provided for under this
act
22 required under section 801 and a $10.00 fund-raising donation.
23 Application for a
replacement fund-raising registration plate
24 shall be accompanied by payment of only the fee prescribed under
25 section 804.
26 (3) The secretary of state may issue a personalized
27 fund-raising registration
plate upon application and the
1 payment of the personalized registration plate fee prescribed
2 under section 803b in addition to the fees and donations
3 prescribed under subsection (2) and the regular vehicle
4 registration tax provided
for prescribed under this act.
5 (4) A disabled person
who makes application applies for a
6 fund-raising registration
plate under this section and who
7 makes payment of pays the required service fees shall be
8 issued, as determined by the secretary of state, a disabled
9 person's tab plate
as provided in section 803f 803d for his
10 or her fund-raising registration
plate. or a disabled person's
11 fund-raising
registration plate. The secretary of
state shall
12 require the same proof that the applicant is a disabled person as
13 is required for issuance of a permanent windshield placard under
14 section 675.
15 (5) A fund-raising registration
plate shall expire
16 expires pursuant to section 226. The secretary of state may
17 issue a tab or tabs designating the month and year of expiration
18 for an original or
renewal fund-raising registration plate.
19 (6) The secretary of state may issue a temporary registration
20 permit to a person who submits an application and the proper fees
21 and donation for a
fund-raising registration plate, if the
22 applicant's current vehicle registration will expire before his
23 or her receipt of a
fund-raising registration plate. The
24 temporary registration shall expire upon the applicant's receipt
25 of a fund-raising registration
plate or upon the expiration of
26 60 30 days after the date of issuance, whichever
occurs first.
27 The temporary permit shall be issued without a separate fee.
1 Sec. 811g. (1) Except as otherwise provided in this act,
2 the secretary of state may develop, market, promote, and sell a
3 collector plate. that
matches any registration plate issued by
4 the secretary of state
under this act. However, the
secretary of
5 state shall only develop, market, and promote a collector plate
6 with funds available from the collection of service fees under
7 this chapter.
8 (2) A collector plate shall not be attached to a motor
9 vehicle in a manner prescribed in section 225. A collector plate
10 may be used on a vehicle in any lawful manner, including, but not
11 limited to, being displayed on the front bumper of a vehicle.
12 (3) A person may purchase 1 or more collector plates by
13 making payment to the secretary of state of the $10.00 service
14 fee and , if the
plate is a matching Michigan university or
15 state-sponsored
fund-raising registration plate as defined in
16 section 811e, a $25.00 fund-raising donation.
17 (4) The secretary of state may, as determined necessary by
18 the secretary of state, cease to sell a collector plate.
19 Sec. 811h. (1) Each service fee collected under sections
20 811f and 811g shall be credited to the transportation
21 administration collection fund created under section 810b.
22 (2) The secretary of state shall identify and segregate the
23 fund-raising donations collected under sections 811f and 811g
24 into separate accounts. The secretary of state shall create a
25 separate account for each
fund-raising plate series and
26 matching its collector plates issued or sold by the
secretary
27 of state. for
a Michigan university or state-sponsored goal
1 pursuant to section
811e.
2 (3) As determined necessary by the secretary of state but not
3 more than 45 days after the end of each calendar quarter, the
4 secretary of state shall not less than once each calendar quarter
5 authorize the disbursement of fund-raising donations segregated
6 under subsection (2) and, independent from any disbursement under
7 subsection (2), report the number of each type of fund-raising
8 registration and matching collector plates issued, sold,
or
9 renewed bearing the
design or logo of that Michigan university
10 or state-sponsored
plate sponsor, to the following, as
11 appropriate:
12 (a) The treasurer of a Michigan university.
13 (b) The person or entity identified in a public act pursuant
14 to section 811e(3) 811e
to administer a state-sponsored
15 fund-raising registration plate fund.
16 (c) The sponsor of a fund-raising plate issued as prescribed
17 under section 811e that was developed and issued after the
18 effective date of the amendatory act that added this
19 subdivision.
20 (4) A fund-raising plate created after the effective date of
21 the amendatory act that added this subsection shall meet or
22 exceed the following sales goals:
23 (a) In the first year, 2,000 plates.
24 (b) In the second and each subsequent year for 5 years, 500
25 original plates.
26 (5) (4) The
secretary of state may cease to issue a
27 fund-raising registration
plate or to issue a duplicate
1 replacement of a fund-raising
registration plate for use on a
2 vehicle if the
secretary of state issued fewer than 500 of a
3 particular
fund-raising registration plate within any prior 24
4 consecutive months that fund-raising plate fails to meet a sales
5 goal described in subsection (4). The secretary of state may
6 also cease to sell a collector plate that matches the
7 discontinued fund-raising
registration plate. However, the
8 secretary of state may continue to renew fund-raising
9 registration plates already issued and collect the renewal
10 fund-raising donation for
those plates. This subsection does
11 not apply to Michigan
university fund-raising registration plates
12 issued under section
811f and matching Michigan university
13 collector plates
issued under section 811g.
14 (6) (5) The
state of Michigan, through the secretary of
15 state, shall own all right, title, and interest in all
16 fund-raising registration
plates and collector plates,
17 including the right to use, reproduce, or distribute a
18 fund-raising registration
or collector plate or the image of a
19 fund-raising registration
or collector plate in any form. The
20 secretary of state may authorize the commercial or other use of a
21 fund-raising registration
or collector plate design, logo, or
22 image if written consent is obtained from the pertinent Michigan
23 university or other
person or entity that sponsored a
24 state-sponsored fund-raising registration plate. under
25 section 811e. However, the secretary of state shall not
26 authorize the commercial or other use of a fund-raising
27 registration or collector plate under this section unless the
1 user first agrees in writing to the terms and conditions that the
2 secretary of state considers necessary. Those terms and
3 conditions may include the payment of royalty fees to 1 or more
4 of the following:
5 (a) This state.
6 (b) A Michigan university.
7 (c) A Another
person or entity that sponsored a
8 state-sponsored fund-raising registration plate.
9 (7) (6) A
royalty fee paid to this state under a written
10 agreement described in
subsection (5) (6) shall be credited to
11 the Michigan transportation
administration collection fund.
12 established under
section 10 of 1951 PA 51, MCL 247.660.
13 (8) Beginning not later than February 1, 2005, and annually
14 after that, an organization receiving fund-raising donations
15 disbursed under this section shall report to the state
16 treasurer. A report under this subsection shall include a
17 summary of expenditures during the preceding year of the money
18 received under this section.
19 Sec. 811i. (1)
The secretary of state shall develop under
20 section 811e and, upon
application, may issue under section 811f
21 a state-sponsored
water quality fund-raising registration plate
22 and a matching
state-sponsored water quality collector plate as
23 provided under section
811g. The plate shall be of a design as
24 determined by the
secretary of state after consultation with and
25 advice of the director
of the department of environmental
26 quality.
27 (1) (2)
Water quality fund-raising registration
1 Fund-raising plate donations collected for plates recognizing the
2 water quality of this state
under section 811f and matching
3 water quality collector plate fund-raising donations collected
4 under section 811g shall be disbursed under section 811h by the
5 secretary of state to the state treasurer, who shall credit the
6 donation money to the water quality protection fund created under
7 subsection (4) (3).
8 (2) (3) The
department of environmental quality shall
9 establish and administer a "water quality protection fund grant
10 program" and shall set policy and oversee this program. The
11 program shall provide grants to local units of government for the
12 purpose of protecting the
water quality of the Michigan great
13 lakes Great Lakes and inland lakes, rivers, and
streams. The
14 department of environmental quality may promulgate rules to
15 implement this grant program under the administrative procedures
16 act of 1969, 1969 PA 306, MCL 24.201 to 24.328.
17 (3) (4) The
water quality protection fund is created within
18 the state treasury. The state treasurer may receive money or
19 other assets from any source for deposit into the fund. The
20 state treasurer shall direct the investment of the fund. The
21 state treasurer shall credit to the fund interest and earnings
22 from fund investments. Money in the fund at the close of the
23 fiscal year shall remain in the fund and shall not lapse to the
24 general fund. Money from the fund shall be expended, upon
25 appropriation, only for the purpose of protecting the water
26 quality of the Michigan great
lakes Great Lakes and inland
27 lakes, rivers, and streams.
1 (4) (5) For
purposes of this chapter, : (a) "Local
2 "local unit of government" means any of the following:
3 (a) (i) A county,
city, village, or township.
4 (b) (ii) An agency
of a county, city, village, or
5 township.
6 (c) (iii) The
office of a county drain commissioner.
7 (d) (iv) A soil
conservation district established under
8 part 93 of the natural resources and environmental protection
9 act, 1994 PA 451, MCL 324.9301 to 324.9313.
10 (e) (v) A
watershed council established under part 311 of
11 the natural resources and environmental protection act, 1994 PA
12 451, MCL 324.31101 to 324.31119.
13 (f) (vi) A local
health department as that term is defined
14 in section 1105 of the public health code, 1978 PA 368, MCL
15 333.1105.
16 (g) (vii) A
community college or junior college established
17 pursuant to section 7 of article VIII of the state constitution
18 of 1963.
19 (h) (viii) A 4-year
institution of higher education, public
20 or private, located in this state.
21 (i) (ix) An
authority or other public body created by or
22 pursuant to state law.
23 (b) "Water
quality fund-raising registration plate" means a
24 registration plate
containing a specialized design pertaining to
25 the water quality of
this state.
26 Sec. 811j. (1) The
secretary of state shall develop under
27 section 811e and, upon
application, may issue under section 811f
1 a state-sponsored A fund-raising plate or collector plate
2 recognizing children's
trust fund-raising registration plate and
3 a matching
state-sponsored children's trust collector plate as
4 provided under section
811g. The plate shall be of a
design as
5 determined by the secretary of state after consultation with the
6 state child abuse and neglect prevention board created in section
7 3 of the child abuse and neglect prevention act, 1982 PA 250, MCL
8 722.603.
9 (2) Children's
trust fund-raising registration plate
10 Fund-raising donations for plates recognizing children's trust
11 collected under section
811f and matching children's trust
12 collector plate
fund-raising donations collected under section
13 sections 811f and 811g shall be transferred under section 811h by
14 the secretary of state to the state treasurer, who shall credit
15 the donation money to the children's trust fund created under
16 section 1 of 1982 PA 249, MCL 21.171, for the support and benefit
17 of the children of this state.
18 (3) For purposes
of this chapter, "state-sponsored
19 children's trust
fund-raising registration plate" means a
20 registration plate
containing a specialized design pertaining to
21 the children of this
state.
22 Sec. 811k. (1)
The secretary of state shall develop under
23 section 811e and, upon
application, may issue under section 811f
24 a state-sponsored
lighthouse fund-raising registration plate and
25 a matching
state-sponsored lighthouse fund-raising collector
26 plate as provided
under section 811g. The plate shall be of a
27 design as determined
by the secretary of state.
1 (1) (2) The
Michigan lighthouse preservation grant fund is
2 created as a separate fund in the department of treasury. The
3 fund shall be expended only as provided in this section. The
4 state treasurer may receive money or other assets from any source
5 for deposit into the fund. The state treasurer shall direct the
6 investment of the fund. The state treasurer shall credit to the
7 fund interest and earnings from fund investments. The state
8 treasurer shall annually
present to the secretary of state
9 department of history, arts, and libraries an accounting of the
10 amount of money in the fund. Money in the fund at the close of
11 the fiscal year shall remain in the fund and shall not lapse to
12 the general fund.
13 (2) (3) The
secretary of state department of history,
14 arts, and libraries shall administer the Michigan lighthouse
15 preservation fund and may
expend money from the that fund
16 through discretionary historical grants to preserve Michigan
17 lighthouses. The secretary
of state department of history,
18 arts, and libraries shall
not use not more than 10% of the
19 funds for the
secretary of state's costs that occur from fund
20 administration and grant project coordination.
21 (3) (4) The
secretary of state department of history,
22 arts, and libraries may award grants under subsection (2) for the
23 preparation of plans and specifications for restoration and
24 stabilization and for stabilization, rehabilitation, or other
25 preservation work on a Michigan lighthouse, but grants shall not
26 be awarded for
operational purposes. The secretary of state
27 department of history, arts, and libraries shall allocate grant
1 funds pursuant to eligibility and scoring requirements
2 established by the secretary
of state department of history,
3 arts, and libraries. To award grants under this section, the
4 secretary of state department of history, arts, and libraries
5 shall solicit applications from eligible recipients, score
6 applications based on the established criteria, and award grants
7 through executed contracts. All plans and work performed under a
8 grant shall be consistent with the United States secretary of the
9 interior's standards for rehabilitation and guidelines for
10 rehabilitating historic
buildings, 36 C.F.R. 36 CFR 67,
11 historic preservation certifications.
12 (4) (5)
Lighthouse fund-raising registration plate donations
13 collected under
section 811f and matching lighthouse collector
14 plate fund-raising
donations collected under section
15 Fund-raising donations for plates recognizing the historical
16 lighthouses of this state under sections 811f and 811g shall be
17 transferred under section
811m 811h by the secretary of state
18 department of history, arts, and libraries to the state
19 treasurer, who shall credit the donation money to the Michigan
20 lighthouse preservation grant fund for the preservation of
21 historic Michigan lighthouses.
22 (6) For purposes
of this chapter, "state-sponsored
23 lighthouse
fund-raising registration plate" means a registration
24 plate containing a
specialized design pertaining to historic
25 Michigan lighthouses.
26 Sec. 811l. (1) The secretary of state shall develop under
27 section 811e and, upon
application, may issue under section 811f
1 a state-sponsored
critical nongame wildlife habitat fund-raising
2 registration plate and
a matching state-sponsored critical
3 nongame wildlife
habitat collector plate as provided under
4 section 811g. The
plate A fund-raising plate or
collector plate
5 recognizing the critical nongame wildlife habitats of this state
6 shall be of a design as determined by the secretary of state
7 after consultation consulting
with the director of the
8 department of natural resources.
9 (2) Critical
nongame wildlife habitat fund-raising
10 registration plate
donations collected under section 811f and
11 matching critical
nongame wildlife habitat collector plate
12 fund-raising donations
Fund-raising donations for plates
13 described in subsection (1)
collected under section sections
14 811f and 811g shall be transferred under section 811h by the
15 secretary of state to the state treasurer, who shall credit the
16 donation money to the nongame fish and wildlife trust fund
17 created under section 43902 of the natural resources and
18 environmental protection act, 1994 PA 451, MCL 324.43902.
19 (3) For purposes
of this chapter, "state-sponsored critical
20 nongame wildlife
habitat fund-raising registration plate" means a
21 registration plate
containing a specialized design pertaining to
22 the critical nongame
wildlife habitats of this state.
23 Sec. 811m. Fund-raising donations for plates recognizing
24 the Michigan veterans memorial collected under sections 811f and
25 811g shall be transferred under section 811h by the secretary of
26 state to the state treasurer, who shall credit the donation money
27 to the Vietnam veterans memorial monument fund created in section
1 3 of the Michigan Vietnam veterans memorial act, 1988 PA 234, MCL
2 35.1053. These donations shall be used exclusively for the
3 purposes described in sections 5 and 7 of the Michigan Vietnam
4 veterans memorial act, 1988 PA 234, MCL 35.1055 and 35.1057.
5 Sec. 811n. (1)
The secretary of state shall develop under
6 section 811e and, upon
application, may issue under section 811f
7 a state-sponsored
agricultural heritage fund-raising registration
8 plate and a matching
state-sponsored agricultural heritage
9 collector plate as
provided under section 811g. (2) Agricultural
10 heritage fund-raising
registration plate Fund-raising
donations
11 collected under
section 811f and matching agricultural heritage
12 collector plate
fund-raising donations for plates
recognizing
13 the agricultural heritage of this state collected under section
14 sections 811f and 811g shall be transferred under section 811h by
15 the secretary of state to the state treasurer, who shall disburse
16 the donation money to Michigan state university development,
17 designated for the FFA vision2000 endowment fund, for the purpose
18 of providing grants for agri-science, natural resources, and
19 environmental K-12 educational programs.
20 (3) For purposes
of this chapter, "state-sponsored
21 agricultural heritage
fund-raising registration plate" means a
22 registration plate
containing a specialized design pertaining to
23 the agricultural
heritage of this state.
24 Sec. 811o. (1) A fund-raising plate or collector plate
25 recognizing American pride shall be of a design as determined by
26 the secretary of state and contain the words "proud to be
27 American" and "Michigan". Fund-raising donations for plates
1 recognizing American pride collected under sections 811f and 811g
2 shall be transferred under section 811h by the secretary of state
3 to the state treasurer, who shall disburse the donation money to
4 the proud to be American fund established under this section.
5 (2) The proud to be American fund is created within the state
6 treasury. The state treasurer may receive money or other assets
7 from any source for deposit into the fund. The state treasurer
8 shall direct the investment of the fund. The state treasurer
9 shall credit to the fund interest and earnings from fund
10 investments.
11 (3) Money in the fund at the close of the fiscal year shall
12 remain in the fund and shall not lapse to the general fund.
13 (4) The state treasurer shall disburse money in the fund on a
14 monthly basis as follows:
15 (a) Fifty percent to the American National Red Cross
16 established under 36 USC 300101 as represented by the Michigan
17 state service council.
18 (b) Fifty percent to the Salvation Army.
19 (5) The American National Red Cross and the Salvation Army
20 shall expend the money received under this section for disaster
21 preparedness and disaster relief in the United States of
22 America.
23 (6) The American National Red Cross and the Salvation Army
24 shall annually report to the department of treasury an accounting
25 of money received and used under this section.
26 Sec. 811p. (1) A fund-raising plate or collector plate
27 recognizing the Olympic education-training center in this state
1 shall bear an appropriate logo, the design of which the Olympic
2 education-training center shall submit to the secretary of
3 state. The secretary of state shall confer with the department
4 of state police to ensure that the design will not compromise the
5 ability of law enforcement agencies to accurately identify
6 specific vehicles.
7 (2) Registration plates bearing an Olympic education-training
8 center logo shall not be a duplication of another registration
9 plate. The Olympic education-training center shall comply with
10 section 803m(2), (3)(c) and (d), and (4)(c) and (d).
11 (3) Fund-raising donations for plates recognizing the Olympic
12 education-training center collected under section 811f or 811g
13 shall be transferred by the secretary of state to the state
14 treasurer, who shall credit the funds to the Olympic
15 education-training center fund. The money in the Olympic
16 education-training center fund shall, upon appropriation, be
17 distributed to the Olympic education-training center.
18 Enacting section 1. Sections 217m, 217n, and 811c of the
19 Michigan vehicle code, 1949 PA 300, MCL 257.217m, 257.217n, and
20 257.811c, are repealed.
21 Enacting section 2. Enacting section 1 of 2000 PA 77 is
22 repealed.
