A bill to amend 1939 PA 280, entitled
"The social welfare act,"
by amending section 107 (MCL 400.107).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 107. (1)
In Except as provided in subsection (2), in
2 establishing financial eligibility for the medically indigent as
3 defined in section 106
(2) 106 income shall be disregarded in
4 accordance with standards established for the related categorical
5 assistance program. Additional income shall be applied against:
6 (i) the cost of medical care not authorized under this act, and
7 (ii) the cost of services authorized under this act, in excess of
8 the basic amount. For medical assistance only, income shall
9 include the amount of
contribution which that an estranged
10 spouse or parent for a minor child is making to the applicant
11 according to the standards of the state department, or pursuant
1 to a court determination, if there is such a determination.
2 Nothing in this section shall
eliminate eliminates the
3 responsibility of support established in section 76 for cash
4 assistance received under this act.
5 (2) For the purpose of determining financial eligibility, the
6 family independence agency shall deduct from an individual's
7 annual income that individual's verifiable annual expense for
8 mandatory automobile insurance.
9 (3) As used in this section, "mandatory automobile insurance"
10 means the security required under section 3101 or 3103 of the
11 insurance code of 1956, 1956 PA 218, MCL 500.3101 and 500.3103.
