A bill to amend 1921 PA 207, entitled
"City and village zoning act,"
by amending section 1 (MCL 125.581), as amended by 1995 PA 36.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1. (1) The legislative body of a city or village may
2 adopt a zoning ordinance to regulate and restrict the use of land
3 and structures ; to for
1 or more of the following purposes:
4 (a) To meet the needs of the state's residents for food,
5 fiber, energy and other natural resources, places of residence,
6 recreation, industry,
trade, service, and other uses of land. ;
7 to insure that uses of
the land shall be situated in appropriate
8 locations and
relationships; to
9 (b) To ensure that the locations of and relationships between
10 land uses are appropriate.
11 (c) To limit
the inappropriate overcrowding crowding of
1 land uses and congestion of population and transportation systems
2 and other public
facilities. ; to
3 (d) To facilitate adequate and efficient provision for
4 transportation systems, sewage disposal, water, energy,
5 education, recreation, and other public service and facility
6 needs. ; and
to
7 (e) To promote
public health, safety, and welfare. , and for
8 those purposes
9 (2) For the purposes set forth in subsection (1), a zoning
10 ordinance may divide a city or village into districts of the
11 number, shape, and area considered by the legislative body to be
12 best suited to carry out this section. For each of those
13 districts regulations may be imposed designating the uses for
14 which buildings or structures shall or shall not be erected or
15 altered, and designating the trades, industries, and other land
16 uses or activities that shall be permitted or excluded or
17 subjected to special regulations. The zoning ordinance may
18 provide for a mix of land uses and activities in a district or
19 may provide for the separation of different land uses and
20 activities in different districts, or both.
21 (3) (2) The
land development regulations and districts
22 authorized by this act shall be made in accordance with a plan
23 designed to promote and accomplish the objectives of this act.
24 (4) (3) An
ordinance adopted pursuant to this act is
25 subject to the electric transmission line certification act, 1995
26 PA 30, MCL 460.561 to 460.575.
