A bill to amend 1939 PA 288, entitled
"Probate code of 1939,"
(MCL 710.21 to 712A.32) by adding section 65a to chapter X and
section 18 to chapter XII.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 CHAPTER X
2 Sec. 65a. (1) If a dispute regarding the legal custody of a
3 child is pending under this chapter, an individual who is a party
4 to the dispute and who is the child's biological parent may
5 petition to be granted supervised parenting time. If the court
6 determines that parenting time will not harm the child, the court
7 shall order supervised parenting time in the amount and under the
8 conditions the court determines appropriate.
9 (2) If a person that has physical custody of the child
10 interferes with supervised parenting time ordered by the court
1 under this section and if the court determines that the
2 interference was unwarranted, the court shall order that person
3 to pay the parent's court costs, attorney fees, and other
4 expenses incurred as a result of the interference. The court may
5 also order the person to pay a civil fine of not more than
6 $1,000.00 for each separate occurrence of interfering with the
7 parent's and child's parenting time.
8 CHAPTER XII
