A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
by amending sections 43506 and 43536a (MCL 324.43506 and
324.43536a), section 43506 as amended by 1996 PA 585 and section
43536a as amended by 2003 PA 4.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 43506. (1)
"Open season" means the time period
2 during which game animals, game birds, fur-bearing animals, and
3 aquatic species may be legally taken or killed. Open season
4 includes both the first
and last day of the season or period.
5 (2) "Reptile" means a turtle, snake, lizard, or any other
6 member of the class reptilia.
7 (3) "Resident" means any of the following:
8 (a) A person who resides in a settled or permanent home or
9 domicile within the boundaries of this state with the intention
1 of remaining in this state.
2 (b) A student who is enrolled in a full-time course at a
3 college or university within this state and who resides in the
4 state during the school year.
5 (c) A foreign exchange student who is enrolled in an
6 elementary or secondary institution of learning in this state for
7 any grade through 12 and who resides with a person described in
8 subdivision (a) during the school year.
9 (d) (c) A
person regularly enlisted or commissioned as an
10 officer in the armed forces of the United States and officially
11 stationed in this state.
12 (e) (d) A
person regularly enlisted or commissioned as an
13 officer in the armed forces of the United States who, at the time
14 of enlistment, was a resident of this state and has maintained
15 his or her residence in this state for purposes of obtaining a
16 driver license or voter registration, or both.
17 Sec. 43536a. (1) A member of the military may obtain any
18 license under this part for which a lottery is not required for
19 $1.00 upon presentation of leave papers, duty papers, military
20 orders, or other evidence acceptable to the department verifying
21 that he or she is stationed outside of this state. The license
22 is valid for a period of up to 2 weeks designated by the member
23 of the military but only during the season in which such a
24 license would otherwise be valid.
25 (2) As used in this section, "member of the military" means
26 either of the following:
27 (a) A person
described by section 43506(3)(d) 43506(3)(e)
1 who is stationed outside this state.
2 (b) A person who meets all of the following requirements:
3 (i) The person is a reserve component soldier, sailor,
4 airman, or marine called to federal active duty.
5 (ii) At the time the person was called to federal active
6 duty, he or she was a resident of this state.
7 (iii) The person is stationed outside this state.
8 (iv) The person has maintained his or her residence in this
9 state for the purpose of obtaining a driver license or voter
10 registration, or both.
