A bill to amend 1931 PA 328, entitled
"The Michigan penal code,"
(MCL 750.1 to 750.568) by adding section 377d.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 377d. (1) A person who contaminates or destroys
2 agricultural property with the intent to create terror is guilty
3 of a felony punishable by imprisonment for not more than 4 years
4 or a fine of not more than $2,000.00, or both.
5 (2) This section does not prohibit the person from being
6 charged with, convicted of, and sentenced for the contamination
7 or destruction as well as for the violation of this section.
8 (3) As used in this section:
9 (a) "Agricultural property" means any real property or
10 personal property used in a farm operation.
11 (b) "Farm operation" means that term as defined in section 2
1 of the Michigan right to farm act, 1981 PA 93, MCL 286.472.
