                                                                                 A bill to amend 1984 PA 431, entitled                                             

                                                                                

    "The management and budget act,"                                            

                                                                                

    by amending section 227 (MCL 18.1227).                                      

                                                                                

                THE PEOPLE OF THE STATE OF MICHIGAN ENACT:                      

                                                                                

1       Sec. 227.  (1) The department shall establish, operate, and                 

                                                                                

2   maintain parking for state buildings and facilities operated by             

                                                                                

3   the department.                                                             

                                                                                

4       (2) If the department intends to relocate a state employee                  

                                                                                

5   from an assigned or designated parking location to a new parking            

                                                                                

6   location, or from a current work site to a new work site, the               

                                                                                

7   department shall conduct a study to determine the number of                 

                                                                                

8   parking spaces available at the new location.  The department               

                                                                                

9   shall only relocate or reassign a state employee to the new                 

                                                                                

10  parking location or work site if parking spaces are available               

                                                                                

11  there to accommodate each relocated state employee.                         

                                                                                


                                                                                

1       (3) The department may establish and collect fees for parking               

                                                                                

2   on state operated parking facilities from state employees, state            

                                                                                

3   officials, and from the general public.                                     

                                                                                

4       (4) Subject to subsection (5), the department shall not                     

                                                                                

5   charge a relocated or reassigned state employee as described in             

                                                                                

6   subsection (2) parking fees at a rate greater than the rate the             

                                                                                

7   state employee was charged to park at the state employee's                  

                                                                                

8   prerelocation or prereassignment parking location.  This                    

                                                                                

9   subsection applies to parking fees charged on and after January             

                                                                                

10  1, 2001.                                                                    

                                                                                

11      (5) The department shall not increase parking fees annually                 

                                                                                

12  at a greater rate than the percentage increase in the consumer              

                                                                                

13  price index for the United States for the immediately preceding             

                                                                                

14  calendar year as defined and officially reported by the United              

                                                                                

15  States department of labor bureau of labor statistics and as                

                                                                                

16  certified by the state treasurer.  This subsection applies to               

                                                                                

17  parking fees charged on and after January 1, 2001.                          

                                                                                

18      (6) The fees, penalties, and fines collected under this                     

                                                                                

19  section shall be credited to the state general fund.                        

                                                                                

20      (7) The department shall promulgate rules pursuant to section               

                                                                                

21  131(2) relative to the operation of the state operated parking              

                                                                                

22  facilities.  The rules shall provide for the assessment of                  

                                                                                

23  penalties and fines, for the removal of vehicles, and for a                 

                                                                                

24  grievance process.
